TÉRMINOS Y CONDICIONES PARA EL USO DE LA APP MUNILY

Reglamento de uso de la aplicación móvil.

El presente documento establece las condiciones mediante las cuales se regirá el uso de la aplicación móvil: web de Munily, cuyo dominio es https://www.munily.com , a todos sus sitio/apps relacionados o vinculados desde https://www.munily.com (en adelante la aplicación), la cual es operada por MUNILY S.A.S., identificada con Nit. 901.416.819-1., la cual es una persona jurídica de derecho privado, registrada en la Cámara de Comercio de Bogotá bajo la matrícula 03292040. El usuario se compromete a leer los términos y condiciones aquí establecidos y con su aceptación se entiende que cuenta con el conocimiento integral de este documento y la totalidad de sus estipulaciones. El usuario reconoce que el ingreso de su información personal, y los datos que contiene la aplicación a su disposición respecto a su información y demás datos personales, la realizan de manera voluntaria, quienes optan por acceder a esta aplicación en Colombia o desde fuera del territorio nacional, lo hacen por iniciativa propia y son responsables del cumplimiento de las leyes locales, en la medida en que dichas leyes sean aplicables en su correspondiente país.

Uso autorizado de la aplicación

La aplicación tiene como finalidad servir de plataforma para la gestión y administración de copropiedades, interconectando administradores, guardas de seguridad, residentes e invitados para brindar soluciones de seguridad y comunicación comunitaria. A menos que estas condiciones de uso establezcan lo contrario de manera explícita, no está permitido copiar, reproducir, volver a publicar, cargar, enviar, exponer públicamente, codificar, traducir, transmitir ni distribuir de manera alguna ninguna parte ni contenido del sitio/app en ningún otro ordenador, servidor, página web ni en otro medio de publicación o distribución sin el consentimiento previo escrito por Munily.

Alcance y uso

El usuario de la aplicación entiende y acepta que, no obstante, es operada por MUNILY S.A.S., la información contenida en la misma será la referente a su vínculo contractual con cada copropiedad, por tanto, las funcionalidades ofrecidas por la aplicación serán entregadas a cada usuario de acuerdo con su vinculación con la propiedad horizontal. En la aplicación se pondrá a disposición del usuario información y/o permitirá la realización de las transacciones determinadas o habilitadas por la propiedad horizontal según el tipo de usuario. MUNILY S.A.S. podrá actualizar, adicionar, modificar o eliminar las funcionalidades en cualquier momento, lo cual acepta el usuario mediante la instalación de la aplicación. En todo caso, al momento de realizar dichas modificaciones se notificarán al usuario a través de la misma aplicación móvil una vez inicie sesión y el usuario podrá decidir si desea continuar disfrutando de los servicios de Munily aceptando los nuevos términos y condiciones aplicables. Los tiempos de respuesta, trámites y demás solicitudes efectuadas por el usuario mediante la aplicación serán procesadas de conformidad con las especificaciones de cada servicio activo en cada propiedad horizontal. El usuario acepta y autoriza que los registros electrónicos de las actividades mencionadas, que realice en la aplicación constituyen plena prueba de los mismos.

Requisitos para uso

El usuario deberá contar con un dispositivo móvil inteligente (Smartphone) o Tableta con sistema operativo Android o IOS, cualquiera de estos con acceso a internet, ambos seguros y confiables. MUNILY S.A.S., no será responsable por la seguridad de los equipos Smartphone propiedad de los usuarios utilizados para el acceso al canal, ni por la disponibilidad del servicio en los dispositivos en los cuales se descargue la aplicación. En la forma permitida por la ley, los materiales de la aplicación se suministran sin garantía de ningún género, expresa o implícita, incluyendo sin limitación las garantías de calidad satisfactoria, comerciabilidad, adecuación para un fin particular o no infracción, por tanto, MUNILY S.A.S. no garantiza el funcionamiento adecuado en los distintos sistemas operativos o dispositivos en los cuales se haga uso de la aplicación. Para acceder a la aplicación, el usuario hará uso de su correo y clave, que lo identifica en su relación con la propiedad horizontal. Adicional a lo anterior se requerirá el factor de doble autenticación implementado por MUNILY S.A.S.

Obligaciones de los usuarios

El Usuario se obliga a usar la aplicación y los contenidos encontrados en ella de una manera diligente, correcta, lícita y en especial, se compromete a NO realizar las conductas descritas a continuación:

Utilizar los contenidos de forma, con fines o efectos contrarios a la ley, a la moral y a las buenas costumbres generalmente aceptadas o al orden público;
Reproducir, copiar, representar, utilizar, distribuir, transformar o modificar los contenidos de la aplicación, por cualquier procedimiento o sobre cualquier soporte, total o parcial, o permitir el acceso del público a través de cualquier modalidad de comunicación pública;
Utilizar los contenidos de cualquier manera que entrañen un riesgo de daño o inutilización de la aplicación o de los contenidos o de terceros;
Suprimir, eludir o manipular el derecho de autor y demás datos identificativos de los derechos de autor incorporados a los contenidos, así como los dispositivos técnicos de protección, o cualesquiera mecanismos de información que pudieren tener los contenidos;
Emplear los contenidos y, en particular, la información obtenida a través de la aplicación para distribuir, transmitir, remitir, modificar, rehusar o reportar la publicidad o los contenidos de esta con fines de venta directa o con cualquier otra clase de finalidad comercial, mensajes no solicitados dirigidos a una pluralidad de personas con independencia de su finalidad, así como comercializar o divulgar de cualquier modo dicha información;
Permitir que terceros usen la aplicación móvil con compartiendo su usuario y contraseña;
Utilizar la aplicación y los contenidos con fines lícitos y/o ilícitos, contrarios a lo establecido en estos Términos y Condiciones, o al uso mismo de la aplicación, que sean lesivos de los derechos e intereses de terceros, o que de cualquier forma puedan dañar, inutilizar, sobrecargar o deteriorar la aplicación y los contenidos o impedir la normal utilización o disfrute de esta y de los contenidos por parte de los usuarios.

Propiedad intelectual

Todo el material informático, gráfico, publicitario, fotográfico, de multimedia, audiovisual y de diseño, así como todos los contenidos, textos y bases de datos puestos a su disposición en esta aplicación están protegidos por derechos de autor y/o propiedad industrial cuyo titular es MUNILY S.A.S. o terceros que han autorizado su uso o explotación MUNILY S.A.S., o su uso se encuentra expresamente autorizado por la ley. Todos los contenidos en la aplicación están protegidos por las normas sobre derecho de autor y por todas las normas nacionales e internacionales que le sean aplicables. Exceptuando lo expresamente estipulado en estos Términos y Condiciones, queda prohibido todo acto de copia, reproducción, modificación, creación de trabajos derivados, venta o distribución, exhibición de los contenidos de esta aplicación, de manera o por medio alguno, incluyendo, más no limitado a, medios electrónicos, mecánicos, de fotocopiado, de grabación o de cualquier otra índole, sin el permiso previo y por escrito de MUNILY S.A.S. o del titular de los respectivos derechos. En ningún caso estos Términos y Condiciones confieren derechos, licencias ni autorizaciones para realizar los actos anteriormente prohibidos. Cualquier uso no autorizado de los contenidos constituirá una violación del presente documento y a las normas vigentes sobre derechos de autor, a las normas vigentes nacionales e internacionales sobre Propiedad Industrial, y a cualquier otra que sea aplicable.

Licencia para copiar para uso personal

Usted podrá leer, visualizar, imprimir y descargar el material de sus productos. Ninguna parte de la aplicación podrá ser reproducida, transmitida o almacenada en otro sitio web o en otra forma de sistema de recuperación electrónico. Ya sea que se reconozca específicamente o no, las marcas comerciales, las marcas de servicio y los logos visualizados en esta aplicación pertenecen a MUNILY S.A.S., o a terceros autorizados. MUNILY S.A.S. no interfiere, no toma decisiones, ni garantiza las relaciones que los usuarios lleguen a sostener o las vinculaciones con terceros que pauten y/o promocionen sus productos y servicios. Estas marcas de terceros se utilizan solamente para identificar los productos y servicios de sus respectivos propietarios y el patrocinio o el aval por parte de MUNILY S.A.S. no se deben inferir con el uso de estas marcas comerciales.

Uso del sitio/app

Queda prohibida la utilización de robots, spiders (arañas) u otros dispositivos automáticos, programas, algoritmos, metodologías o procesos manuales similares para acceder, adquirir, copiar o hacer un seguimiento de parte del sitio/app o su contenido con el fin de obtener o intentar obtener materiales, documentos o información no disponible a través del mismo. Munily se reserva el derecho a prohibir cualquier actividad de esta naturaleza. Queda prohibido explorar, escanear o evaluar la vulnerabilidad del sitio/app o de cualquier red conectada al mismo, así como quebrantar las medidas de seguridad o autenticación del sitio/app o de cualquier red conectada al mismo. No está permitido el rastreo o búsqueda de datos de usuarios, visitantes del sitio/app o de otros clientes de Munily. Tampoco está permitido explotar de manera alguna el sitio/app ni ningún otro servicio o información disponible u ofrecida a través del mismo con el propósito de revelar información, incluyendo sin limitación, la identificación personal o la información que no sea propia facilitada por el sitio/app/app. Aceptas no llevar a cabo ninguna acción que provoque una saturación desproporcionada o innecesaria en la infraestructura del sitio/app o en los sistemas o redes de Munily. Aceptas no emplear ningún dispositivo, programa o rutina con el fin de tratar de interferir en el correcto funcionamiento del sitio/app/app o de cualquier transacción llevada a cabo en el mismo, así como tampoco en el uso que otras personas estén haciendo del sitio/app. No está permitido el uso del sitio/app/app ni de su contenido con fines ilegales o ilícitos según estas condiciones de uso. Tampoco está permitido encargar la realización de ninguna actividad ilegal o que infrinja los derechos de Munily o de terceros.

Indemnización

Aceptas indemnizar y no demandar ni reclamar pérdidas, gastos ni responsabilidades (incluyendo honorarios de abogados) a Munily, sus directivos, administradores, accionistas, empleados, agentes, filiales o asociados, ni en tu nombre ni en el de terceros, a causa de tu uso del sitio/app.

Incumplimiento de las condiciones de uso

Los links de Facebook®, Instagram® y twitter® en esta aplicación pueden mostrar contenido que no están bajo el control de MUNILY S.A.S. En este sentido, MUNILY S.A.S. se limita a poner a disposición el enlace a las plataformas, pero el contenido, acceso y uso son responsabilidad del usuario y de cada una de las plataformas. Aunque esta aplicación MUNILY S.A.S. trata de suministrar links solamente a sitios y aplicaciones de terceros que cumplan con las leyes y regulaciones aplicables y las normas de MUNILY S.A.S., el Usuario debe entender que MUNILY S.A.S. no tiene control sobre la naturaleza y el contenido de esos sitios y no está recomendando estos sitios, la información que contienen, ni los productos o servicios de terceros. MUNILY S.A.S. no acepta responsabilidad por el contenido del sitio de un tercero con el cual existe un link de hipertexto y no ofrece garantía (explícita o implícita) en cuanto al contenido de la información en esos sitios, ya que no recomienda los mismos. Usted debe verificar las secciones de términos y condiciones, política legal y de privacidad de algunos otros sitios de MUNILY S.A.S. o de un tercero con los cuales se enlaza. MUNILY S.A.S. no asume ninguna responsabilidad por pérdida directa, indirecta o consecuencial por el uso de un sitio de un tercero.

Términos y condiciones para grabación de comunicaciones en Propiedad Horizontal

Consentimiento Informado. Al aceptar estos Términos y Condiciones, el residente y/o propietario otorga su consentimiento informado para la grabación de las comunicaciones telefónicas realizadas por el guardia de seguridad en el contexto de la administración y seguridad de la propiedad horizontal.
Propósito de la Grabación. Las grabaciones de comunicaciones se llevarán a cabo exclusivamente con el propósito de garantizar la seguridad, control de acceso y administración adecuada en la propiedad horizontal.
Almacenamiento Seguro. Todas las grabaciones se almacenarán de manera segura y solo el administrador, residente y/o propietario accederá a ellas en situaciones que requieran la verificación de eventos o la resolución de problemas relacionados con la seguridad y administración de la propiedad.
Acceso Restringido. El acceso a las grabaciones estará restringido a personal encargado de la administración de la propiedad horizontal. No se compartirá la información con terceros fuera de la propiedad horizontal sin el consentimiento explícito del propietario/residente, a menos que sea requerido por la ley.
Retención de Datos. Las grabaciones se retendrán durante 8 meses para cumplir con los fines declarados y se eliminarán de manera segura cuando ya no sean requeridas.
Información Transparente. Se proporcionará información transparente y accesible sobre la práctica de grabación de las comunicaciones, incluyendo estos términos y condiciones, para garantizar la comprensión completa por parte del propietario y residente.
Cambios en los Términos. En caso de cambios en estos términos y condiciones, se notificará al propietario y residente de manera oportuna, y se solicitará su consentimiento si es necesario.

Términos y Condiciones para el Uso de Datos Biométricos en Reconocimiento Facial para Propiedades Horizontales

Propósito y Uso de Datos Biométricos

Este sistema utiliza tecnología de reconocimiento facial para verificar la identidad de los visitantes que ingresan a propiedades horizontales. La finalidad del procesamiento de datos biométricos es exclusivamente para la seguridad y el control de acceso en dichas propiedades.
Consentimiento Informado

Al aceptar estos términos, el visitante otorga consentimiento explícito para el uso de sus datos biométricos en el sistema de acceso. La información obtenida será empleada únicamente con fines de seguridad y control de acceso.
Administración y Almacenamiento de Datos

Los datos biométricos serán gestionados y almacenados por la administración de la propiedad horizontal, autorizada por la Asamblea de Propietarios, conforme a las normativas locales de privacidad. Estos datos serán conservados solo durante el tiempo necesario para cumplir con los objetivos de seguridad y control de acceso, y no serán compartidos con terceros sin autorización previa.
Privacidad y Confidencialidad

El manejo de los datos biométricos se realizará con estrictas medidas de seguridad y confidencialidad, protegiendo la información contra accesos no autorizados. Los datos no serán utilizados para ningún fin que no esté especificado en estos términos, ni se compartirán sin consentimiento explícito.
Información Visible y Avisos

Las propiedades horizontales que implementen el sistema de reconocimiento facial deberán instalar un aviso informativo en un área visible, indicando que los datos biométricos de los visitantes serán utilizados únicamente para temas de seguridad y control de acceso.

Términos y Condiciones adicionales para las compras

La moneda con la cual se procesarán todas las transacciones dentro del sitio/app es el peso Colombiano

Se aplicarán Términos y Condiciones adicionales para la adquisición de bienes, así como para ámbitos específicos o prestaciones del sitio/app, promociones o similares, que forman parte de las presentes condiciones de uso. Conscientes acatar dichos Términos y Condiciones adicionales, incluyendo, donde corresponda, el requisito de mayoría de edad para utilizar o participar en dichos servicios o prestaciones. En caso de conflicto entre las presentes condiciones de uso y los Términos y Condiciones por los que se rige una parte o un servicio en particular del sitio/app, prevalecerá lo especificado en los Términos y Condiciones para esa parte o servicio en concreto.

Las obligaciones de Munily, si las hubiera, con respecto a sus productos y servicios se rigen únicamente por los acuerdos según los cuales se venden o prestan, y nada puede inferirse del sitio/app para alterar tales acuerdos.

Munily puede aplicar cambios en los productos y servicios ofrecidos en el sitio/app, o en los precios aplicables a los mismos, en cualquier momento y sin previo aviso. Los materiales del sitio/app con respecto a los productos y servicios pueden estar desfasados, y Munily no se compromete a actualizarlos.

Cada una de estas políticas puede actualizarse cada cierto tiempo, en cuyo caso entrará en vigor de forma inmediata tras la publicación de los cambios en el sitio/app.

Productos, Precios y Beneficios exclusivos de compras en línea Los productos presentados pueden variar en su diseño, color debido a los fabricantes. Los productos presentados con sus precios tienen una fecha de validez o mientras duren existencias, pasada esta fecha, los mismos volverán a su precio regular. Los precios de Internet son exclusivos de este canal, no son un espejo de las tiendas físicas.

Habeas Data

Teniendo en cuenta el público objetivo de la aplicación, esto es, personas con una vinculación vigente a MUNILY S.A.S., de manera enunciativa, administradores, guardas de seguridad, residentes e invitados, etc., el usuario entiende y acepta que la presente aplicación solicitará y utilizará sus datos personales, de acuerdo a las autorizaciones previamente otorgadas por el usuario, en el marco de la Ley 1581 de 2012, la demás normativa que la regule, modifique o derogue y al Manual de Políticas de Datos Personales de Munily S.A.S. el cual podrá ser consultado en la Página web: https://munily.com En caso de que el usuario ingrese los datos de un tercero, no vinculado a Munily S.A.S., o a una copropiedad, manifiesta que tiene la autorización del mismo para generar este ingreso. Munily S.A.S. únicamente tratará estos datos para los fines indicados al inicio. El usuario también acepta que Munily S.A.S. puede recolectar su dirección IP para propósitos de administración de sistemas, para auditar tendencias del uso, desempeño y/o comportamiento de la aplicación en las condiciones establecidas en el aparte particular.

Responsabilidad de MUNILY S.A.S.

MUNILY S.A.S. procurará garantizar disponibilidad, continuidad o buen funcionamiento de la aplicación. MUNILY S.A.S. podrá bloquear, interrumpir o restringir el acceso a esta cuando lo considere necesario para el mejoramiento de la aplicación o por dada de baja de la misma. Se recomienda al Usuario tomar medidas adecuadas y actuar diligentemente al momento de acceder a la aplicación, como, por ejemplo, contar con programas de protección, antivirus, para manejo de malware, spyware y/o herramientas similares en los dispositivos desde donde se estén conectando al sistema. MUNILY S.A.S. no será responsable por: a) Fuerza mayor o caso fortuito; b) Por la pérdida, extravío o hurto de su dispositivo móvil que implique el acceso de terceros a la aplicación móvil; c) Por errores en la digitación o accesos por parte del cliente; d) Por los perjuicios, lucro cesante, daño emergente, morales, y en general sumas a cargo de MUNILY S.A.S., por los retrasos, no procesamiento de información o suspensión del servicio del operador móvil o daños en los dispositivos móviles.

Denegación y retirada del acceso a la aplicación

En el Evento en que un Usuario incumpla estos Términos y Condiciones, o cualesquiera otras disposiciones que resulten de aplicación, MUNILY S.A.S. podrá suspender su acceso a la aplicación.

Términos y condiciones

El Usuario acepta expresamente los Términos y Condiciones, siendo condición esencial para la utilización de la aplicación. En el evento en que se encuentre en desacuerdo con estos Términos y Condiciones, solicitamos abandonar la aplicación inmediatamente. MUNILY S.A.S. podrá modificar los presentes términos y condiciones, avisando a los usuarios de la aplicación mediante publicación en la página Página web: https://munily.com, mediante la difusión de las modificaciones a través de la aplicación, por algún medio electrónico, redes sociales, SMS y/o correo electrónico, lo cual se entenderá aceptado por el usuario si éste continua con el uso de la aplicación.

Jurisdicción

Estos términos y condiciones y todo lo que tenga que ver con esta aplicación, se rigen por las leyes de Colombia.

Uso de información no personal

MUNILY S.A.S. también recolecta información no personal en forma agregada con fines de seguimiento y mejora de nuestros servicios como por ejemplo, el número total de descargas de la aplicación. Utilizamos esta información, que permanece en forma agregada, para monitorear el comportamiento y funcionamiento de la aplicación. Uso de direcciones IP Una dirección de Protocolo de Internet (IP) es un conjunto de números que se asigna automáticamente a su dispositivo móvil cuando usted accede a su proveedor de servicios de internet, o a través de la red de área local (LAN) de su organización o la red de área amplia (WAN). Los servidores web automáticamente identifican su dispositivo móvil por la dirección IP asignada a él durante su sesión en línea. MUNILY S.A.S. podrá recolectar direcciones IP para propósitos de administración de sistemas y para auditar el uso de nuestra aplicación, todo lo anterior de acuerdo con la autorización de protección de datos que se suscribe para tal efecto. Normalmente no vinculamos la dirección IP de un usuario con la información personal de ese usuario, lo que significa que cada sesión de usuario se registra, pero el usuario sigue siendo anónimo para nosotros. Sin embargo, podemos usar las direcciones IP para identificar a los usuarios de nuestra aplicación cuando sea necesario con el objeto de para exigir el cumplimiento de los términos de uso del sitio, o para proteger nuestro servicio, sitio u otros usuarios.

Seguridad y Confidencialidad

MUNILY S.A.S. está comprometida en la protección de la seguridad de su información. MUNILY S.A.S. tiene implementados mecanismos de seguridad que aseguran la protección de la información personal, así como los accesos únicamente al personal y sistemas autorizados, también contra la pérdida, uso indebido y alteración de sus datos de usuario bajo nuestro control. Excepto como se indica en el presente, sólo personal autorizado tiene acceso a la información que nos proporciona. Además, hemos impuesto reglas estrictas a los empleados de MUNILY S.A.S. con acceso a las bases de datos que almacenan información del usuario o a los servidores que hospedan nuestros servicios.

TERMS AND CONDITIONS FOR THE USE OF THE MUNILY APP

Regulations for the use of the mobile application.

This document establishes the conditions governing the use of the mobile application: Munily web, whose domain name is https://www.munily.com to all of its related or linked sites/apps from https://www.munily.com (hereinafter the application), which is operated by MUNILY S.A.S., identified with Nit. 901.416.819-1., which is a legal person of private law, registered in the Chamber of Commerce of Bogota under the registration 03292040. The user agrees to read the terms and conditions set forth herein and by accepting them it is understood that he/she has full knowledge of this document and all of its stipulations. The user acknowledges that the entry of their personal information, and the data contained in the application available to them regarding their information and other personal data, is done voluntarily, those who choose to access this application in Colombia or from outside the national territory, do so on their own initiative and are responsible for compliance with local laws, to the extent that such laws are applicable in their country.

Authorized use of the application

The application is intended to serve as a platform for the management and administration of co-ownerships, interconnecting administrators, security guards, residents and guests to provide security and community communication solutions. Unless otherwise explicitly stated in these terms of use, you may not copy, reproduce, republish, upload, post, publicly display, encode, translate, transmit or distribute in any way any portion or content of the site/app to any other computer, server, web page or other medium for publication or distribution without Munily's prior written consent.

Scope and use

The user of the application understands and accepts that, notwithstanding, it is operated by MUNILY S.A.S., the information contained in the same will be the one referring to its contractual link with each co-ownership, therefore, the functionalities offered by the application will be delivered to each user according to its link with the condominium. The application will make information available to the user and/or will allow the execution of the transactions determined or enabled by the condominium according to the type of user. MUNILY S.A.S. may update, add, modify or eliminate the functionalities at any time, which the user accepts by installing the application. In any case, at the time of making such changes the user will be notified through the same mobile application once logged in and the user can decide whether to continue enjoying the services of Munily accepting the new terms and conditions applicable. The response times, procedures and other requests made by the user through the application will be processed in accordance with the specifications of each active service in each condominium. The user accepts and authorizes that the electronic records of the aforementioned activities carried out in the application constitute full proof of the same.

Requirements for use

The user must have an intelligent mobile device (Smartphone) or Tablet with Android or IOS operating system, any of these with internet access, both secure and reliable. MUNILY S.A.S., will not be responsible for the security of the Smartphone devices owned by the users used to access the channel, nor for the availability of the service in the devices in which the application is downloaded. To the extent permitted by law, the materials of the application are provided without warranty of any kind, express or implied, including without limitation warranties of satisfactory quality, merchantability, fitness for a particular purpose or non-infringement, therefore, MUNILY S.A.S. does not guarantee proper operation on the different operating systems or devices on which the application is used. To access the application, the user will use his/her email and password, which identifies him/her in his/her relationship with the condominium. In addition to the above, the double authentication factor implemented by MUNILY S.A.S. will be required.

Obligations of users

The User undertakes to use the application and the contents found therein in a diligent, correct and lawful manner and, in particular, undertakes NOT to engage in the conduct described below:

Use the contents in a manner, with purposes or effects contrary to law, morality and generally accepted good customs or public order;
Reproduce, copy, represent, use, distribute, transform or modify the contents of the application, by any process or on any support, in whole or in part, or allow public access through any form of public communication;
Use the contents in any way that entails a risk of damage or disablement of the application or the contents or third parties;
Suppress, evade or manipulate the copyright and other data identifying the copyright incorporated to the contents, as well as the technical protection devices, or any information mechanisms that the contents may have;

Terms and conditions for recording communications in Condominium Property

Informed Consent. By accepting these Terms and Conditions, the resident and/or owner grants his/her informed consent to the recording of telephone communications made by the security guard in the context of the administration and security of the condominium.
Purpose of Recording. Recordings of communications shall be made exclusively for the purpose of ensuring security, access control and proper management of the Condominium.
Secure Storage. All recordings will be securely stored and will only be accessed by the manager, resident and/or owner in situations requiring verification of events or resolution of issues related to security and property management.
Restricted Access. Access to the recordings will be restricted to personnel in charge of the management of the condominium. The information will not be shared with third parties outside the condominium without the explicit consent of the owner/resident, unless required by law.
Data Retention. Recordings will be retained for 8 months to fulfill the stated purposes and will be securely deleted when no longer required.
Transparent Information. Transparent and accessible information about the practice of recording communications, including these terms and conditions, shall be provided to ensure full understanding by the owner and resident.
Changes to Terms. In the event of changes to these terms and conditions, the owner and resident will be notified in a timely manner, and their consent will be sought if necessary.

Terms and Conditions for the Use of Biometric Data in Facial Recognition for Horizontal Properties

Purpose and Use of Biometric Data

This system uses facial recognition technology to verify the identity of visitors entering horizontal properties. The purpose of the biometric data processing is exclusively for security and access control in such properties.
Informed Consent

By accepting these terms, the visitor gives explicit consent to the use of his/her biometric data in the access system. The information obtained will be used only for security and access control purposes.
Data Management and Storage

The biometric data will be managed and stored by the management of the condominium, authorized by the Owners' Assembly, in accordance with local privacy regulations. These data will be kept only for the time necessary to meet security and access control purposes, and will not be shared with third parties without prior authorization.
Privacy and Confidentiality

Biometric data will be handled with strict security and confidentiality measures, protecting the information against unauthorized access. The data will not be used for any purpose not specified in these terms, nor will it be shared without explicit consent.

Denial and withdrawal of access to the application

In the event that a User breaches these Terms and Conditions, or any other applicable provisions, MUNILY S.A.S. may suspend the User's access to the application.

Propósito de la Grabación. Las grabaciones de comunicaciones se llevarán a cabo exclusivamente con el propósito de garantizar la seguridad, control de acceso y administración adecuada en la propiedad horizontal.
Almacenamiento Seguro. Todas las grabaciones se almacenarán de manera segura y solo el administrador, residente y/o propietario accederá a ellas en situaciones que requieran la verificación de eventos o la resolución de problemas relacionados con la seguridad y administración de la propiedad.
Acceso Restringido. El acceso a las grabaciones estará restringido a personal encargado de la administración de la propiedad horizontal. No se compartirá la información con terceros fuera de la propiedad horizontal sin el consentimiento explícito del propietario/residente, a menos que sea requerido por la ley.
Retención de Datos. Las grabaciones se retendrán durante 8 meses para cumplir con los fines declarados y se eliminarán de manera segura cuando ya no sean requeridas.

Indemnización

As long as you abide by these Terms of Use, Munily grants you a personal, limited, non-transferable and non-exclusive privilege to access and use the Site/app and its mobile application.

Content

All text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, songs, artwork and programming code ("Content"), including, without limitation, the design, structure, selection, coordination, expression, style and organization of such Content, contained in the Site/app are owned, controlled and licensed by Munily and are protected by trade dress, copyright, patent and trademark laws, as well as other intellectual property rights and unfair competition laws. Unless these terms of use explicitly state otherwise, you may not copy, reproduce, republish, upload, post, publicly display, encode, translate, transmit or distribute in any way any portion or content of the site/app on any other computer, server, web page or other medium for publication or distribution without Munily's prior written consent. You may use the information about Munily products and services available on the site/app provided that you (1) do not remove any proprietary notices from copies of the documents, (2) use such information for personal, non-commercial purposes and do not make copies or post them on any networked computer or other medium, (3) do not alter them, and (4) do not make any additional representations or warranties with respect to such documents.

Site/app usage

Terms and conditions for recording communications in Condominium Property

Informed Consent. By accepting these Terms and Conditions, the resident and/or owner grants his/her informed consent to the recording of telephone communications made by the security guard in the context of the administration and security of the condominium.
Purpose of Recording. Recordings of communications shall be made exclusively for the purpose of ensuring security, access control and proper administration of the Condominium.
Secure Storage. All recordings will be securely stored and will only be accessed by the manager, resident and/or owner in situations requiring verification of events or resolution of issues related to security and property management.
Restricted Access. Access to the recordings will be restricted to personnel in charge of the management of the condominium. The information will not be shared with third parties outside the condominium without the explicit consent of the owner/resident, unless required by law.
Data Retention. Recordings will be retained for 8 months to fulfill the stated purposes and will be securely deleted when no longer required.
Transparent Information. Transparent and accessible information about the practice of recording communications, including these terms and conditions, shall be provided to ensure full understanding by the owner and resident.
Changes to Terms. In the event of changes to these terms and conditions, the owner and resident will be notified in a timely manner, and their consent will be sought if necessary.

Terms and Conditions for the Use of Biometric Data in Facial Recognition for Horizontal Properties

Purpose and Use of Biometric Data
This system uses facial recognition technology to verify the identity of visitors entering horizontal properties. The purpose of biometric data processing is exclusively for security and access control in such properties.
Informed Consent By accepting these terms, the visitor gives explicit consent to the use of his/her biometric data in the access system. The information obtained will be used only for security and access control purposes.
Data Management and Storage
The biometric data will be managed and stored by the administration of the condominium, authorized by the Owners' Assembly, in accordance with local privacy regulations. These data will be kept only for the time necessary to meet security and access control purposes, and will not be shared with third parties without prior authorization.
Privacy and Confidentiality
Biometric data will be handled with strict security and confidentiality measures, protecting the information against unauthorized access. The data will not be used for any purpose not specified in these terms, nor will it be shared without explicit consent.
Visible Information and Notices
Horizontal properties that implement the facial recognition system must install an informative notice in a visible area, indicating that the biometric data of visitors will be used only for security and access control purposes.

Additional terms and conditions for purchases

The currency in which all transactions within the website/app will be processed is the Balboa or its equivalent in US Dollar (USD). Additional Terms and Conditions shall apply to the purchase of goods, as well as to specific areas or features of the site/app, promotions or similar, which form part of these Terms of Use. You agree to abide by such additional Terms and Conditions, including, where applicable, the age of majority requirement to use or participate in such services or features. In the event of any conflict between these Terms of Use and the Terms and Conditions governing a particular part or service of the Site/App, the Terms and Conditions for that particular part or service shall control. Munily's obligations, if any, with respect to its products and services are governed solely by the agreements pursuant to which they are sold or provided, and nothing may be inferred from the site/app to alter such agreements. Munily may implement changes to the products and services offered on the site/app, or to the prices applicable thereto, at any time without notice. The materials on the site/app with respect to products and services may be out of date, and Munily makes no commitment to update them. Each of these policies may be updated from time to time, in which case they will be effective immediately upon posting of the changes on the site/app.

Products, Prices and Exclusive Benefits of Online Shopping

The products presented may vary in design and color due to the manufacturers. The products presented with their prices have a validity date or while stocks last, after this date, they will return to their regular price. Internet prices are exclusive of this channel, they are not a mirror of the physical stores. The ratification is made by express mandate of the Authority, as provided in Article 37, paragraph 1 and 2 of Executive Decree No. 46 of June 23, 2009 (Regulation of the Consumer Protection Law).

Privacy Policy

The terms of the Munily Privacy Policy that apply to this site/app are made a part of these Terms of Use. In addition, by using the site/app, you understand and agree that transfers over the Internet may not be completely private or 100% secure. You acknowledge the possibility that a message or information you send to the site/app may be read or intercepted even though it is encrypted (for example, credit card information).

Exemption from liability

Munily does not warrant that the site/app/, content, services or features will be error-free or uninterrupted, nor does Munily undertake to correct errors without first advising you of the time it will take to do so. Nor does it undertake that your use of the site/app will provide specific results. The site/app and its content are provided on an "as is" and "as available" basis. All information published on the site/app is subject to change without notice. Munily is not responsible for the acts, omissions and conduct of third parties in connection with the misuse of the site/app or Munily's services. Your use of the site/app and its linked sites/apps is at your own risk. The above disclaimer of liability applies to any damages, liability or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transfer, virus, communication line failure, theft or destruction, or unauthorized access, alteration or use, whether for breach of contract, negligence or otherwise. At any time, and without notice, Munily reserves the right to: (1) update, modify, suspend or terminate operation of or access to part or all of the site/app for any reason whatsoever; (2) modify or change part or all of the site/app, as well as any applicable policies or terms; (3) discontinue operation of part or all of the site/app, when necessary to perform maintenance, error correction or other changes. For any of the above cases the user may decide whether to continue enjoying Munily's services by accepting the new terms and conditions.

Limitation of liability

Except where prohibited by law, in no event shall Munily be liable for indirect, incidental, remote, consequential, incidental or incidental damages, including lost profits, consequential damages, or moral damages, even if Munily has been advised of the possibility of such damages. You agree that you understand and agree that Munily may retain any communication with you or any services provided through Munily. Munily may also disclose such data if it is legally required to do so or if it believes that such retention or disclosure is reasonably necessary to (1) comply with legal process, (2) enforce these Terms of Use, (3) respond to claims that such data violates the rights of third parties, or (4) protect the rights, property or safety of Munily, its employees, users or visitors to the site/app and the public. Applicable law and dispute resolution

Reglamento de uso de la aplicación móvil.

El presente documento establece las condiciones mediante las cuales se regirá el uso de la aplicación móvil: web de Munily, cuyo dominio es http://www.munily.com , a todos sus sitio/apps relacionados o vinculados desde http://www.munily.com (en adelante la aplicación), la cual es operada por TECHNOLOGY SOLUTIONS S.A., sociedad debidamente inscrita al Folio 155652812, de la Sección de Micropelículas (Mercantil) del Registro Público de Panamá,, en adelante MUNILY. El usuario se compromete a leer los términos y condiciones aquí establecidos y con su aceptación se entiende que cuenta con el conocimiento integral de este documento y la totalidad de sus estipulaciones. El usuario reconoce que el ingreso de su información personal, y los datos que contiene la aplicación a su disposición respecto a su información y demás datos personales, la realizan de manera voluntaria, quienes optan por acceder a esta aplicación lo hacen por iniciativa propia y son responsables del cumplimiento de las leyes locales, en la medida en que dichas leyes sean aplicables en su correspondiente país.

Uso autorizado de la aplicación

Alcance y uso

El usuario de la aplicación entiende y acepta que, no obstante, es operada por MUNILY, la información contenida en la misma será la referente a su vínculo contractual con cada copropiedad, por tanto, las funcionalidades ofrecidas por la aplicación serán entregadas a cada usuario de acuerdo con su vinculación con la propiedad horizontal. En la aplicación se pondrá a disposición del usuario información y/o permitirá la realización de las transacciones determinadas o habilitadas por la propiedad horizontal según el tipo de usuario. MUNILY podrá actualizar, adicionar, modificar o eliminar las funcionalidades en cualquier momento, lo cual acepta el usuario mediante la instalación de la aplicación. En todo caso, al momento de realizar dichas modificaciones se notificarán al usuario a través de la misma aplicación móvil una vez inicie sesión y el usuario podrá decidir si desea continuar disfrutando de los servicios de MUNILY aceptando los nuevos términos y condiciones aplicables. Los tiempos de respuesta, trámites y demás solicitudes efectuadas por el usuario mediante la aplicación serán procesadas de conformidad con las especificaciones de cada servicio activo en cada propiedad horizontal. El usuario acepta y autoriza que los registros electrónicos de las actividades mencionadas, que realice en la aplicación constituyen plena prueba de los mismos.

Requisitos para uso

El usuario deberá contar con un dispositivo móvil inteligente (Smartphone) o Tableta con sistema operativo Android o IOS, cualquiera de estos con acceso a internet, ambos seguros y confiables. MUNILY, no será responsable por la seguridad de los equipos Smartphone propiedad de los usuarios utilizados para el acceso al canal, ni por la disponibilidad del servicio en los dispositivos en los cuales se descargue la aplicación. En la forma permitida por la ley, los materiales de la aplicación se suministran sin garantía de ningún género, expresa o implícita, incluyendo sin limitación las garantías de calidad satisfactoria, comerciabilidad, adecuación para un fin particular o no infracción, por tanto, MUNILY no garantiza el funcionamiento adecuado en los distintos sistemas operativos o dispositivos en los cuales se haga uso de la aplicación. Para acceder a la aplicación, el usuario hará uso de su correo y clave, que lo identifica en su relación con la propiedad horizontal. Adicional a lo anterior se requerirá el factor de doble autenticación implementado por MUNILY.

Obligaciones de los usuarios

Utilizar los contenidos de forma, con fines o efectos contrarios a la ley, a la moral y a las buenas costumbres generalmente aceptadas o al orden público;
Reproducir, copiar, representar, utilizar, distribuir, transformar o modificar los contenidos de la aplicación, por cualquier procedimiento o sobre cualquier soporte, total o parcial, o permitir el acceso del público a través de cualquier modalidad de comunicación pública;
Utilizar los contenidos de cualquier manera que entrañen un riesgo de daño o inutilización de la aplicación o de los contenidos o de terceros;
Suprimir, eludir o manipular el derecho de autor y demás datos identificativos de los derechos de autor incorporados a los contenidos, así como los dispositivos técnicos de protección, o cualesquiera mecanismos de información que pudieren tener los contenidos;
Emplear los contenidos y, en particular, la información obtenida a través de la aplicación para distribuir, transmitir, remitir, modificar, rehusar o reportar la publicidad o los contenidos de esta con fines de venta directa o con cualquier otra clase de finalidad comercial, mensajes no solicitados dirigidos a una pluralidad de personas con independencia de su finalidad, así como comercializar o divulgar de cualquier modo dicha información;
Permitir que terceros usen la aplicación móvil con compartiendo su usuario y contraseña;
Utilizar la aplicación y los contenidos con fines lícitos y/o ilícitos, contrarios a lo establecido en estos Términos y Condiciones, o al uso mismo de la aplicación, que sean lesivos de los derechos e intereses de terceros, o que de cualquier forma puedan dañar, inutilizar, sobrecargar o deteriorar la aplicación y los contenidos o impedir la normal utilización o disfrute de esta y de los contenidos por parte de los usuarios.

Propiedad intelectual

Todo el material informático, gráfico, publicitario, fotográfico, de multimedia, audiovisual y de diseño, así como todos los contenidos, textos y bases de datos puestos a su disposición en esta aplicación están protegidos por derechos de autor y/o propiedad industrial cuyo titular es MUNILY. o terceros que han autorizado su uso o explotación MUNILY, o su uso se encuentra expresamente autorizado por la ley. Todos los contenidos en la aplicación están protegidos por las normas sobre derecho de autor y por todas las normas nacionales e internacionales que le sean aplicables. Exceptuando lo expresamente estipulado en estos Términos y Condiciones, queda prohibido todo acto de copia, reproducción, modificación, creación de trabajos derivados, venta o distribución, exhibición de los contenidos de esta aplicación, de manera o por medio alguno, incluyendo, más no limitado a, medios electrónicos, mecánicos, de fotocopiado, de grabación o de cualquier otra índole, sin el permiso previo y por escrito de MUNILY. o del titular de los respectivos derechos. En ningún caso estos Términos y Condiciones confieren derechos, licencias ni autorizaciones para realizar los actos anteriormente prohibidos. Cualquier uso no autorizado de los contenidos constituirá una violación del presente documento y a las normas vigentes sobre derechos de autor, a las normas vigentes nacionales e internacionales sobre Propiedad Industrial, y a cualquier otra que sea aplicable.

Licencia para copiar para uso personal

Usted podrá leer, visualizar, imprimir y descargar el material de sus productos. Ninguna parte de la aplicación podrá ser reproducida, transmitida o almacenada en otro sitio web o en otra forma de sistema de recuperación electrónico. Ya sea que se reconozca específicamente o no, las marcas comerciales, las marcas de servicio y los logos visualizados en esta aplicación pertenecen a MUNILY, o a terceros autorizados. MUNILY no interfiere, no toma decisiones, ni garantiza las relaciones que los usuarios lleguen a sostener o las vinculaciones con terceros que pauten y/o promocionen sus productos y servicios. Estas marcas de terceros se utilizan solamente para identificar los productos y servicios de sus respectivos propietarios y el patrocinio o el aval por parte de MUNILY no se deben inferir con el uso de estas marcas comerciales.

Uso del sitio/app

Queda prohibida la utilización de robots, spiders (arañas) u otros dispositivos automáticos, programas, algoritmos, metodologías o procesos manuales similares para acceder, adquirir, copiar o hacer un seguimiento de parte del sitio/app o su contenido con el fin de obtener o intentar obtener materiales, documentos o información no disponible a través del mismo. MUNILY se reserva el derecho a prohibir cualquier actividad de esta naturaleza. Queda prohibido explorar, escanear o evaluar la vulnerabilidad del sitio/app o de cualquier red conectada al mismo, así como quebrantar las medidas de seguridad o autenticación del sitio/app o de cualquier red conectada al mismo. No está permitido el rastreo o búsqueda de datos de usuarios, visitantes del sitio/app o de otros clientes de MUNILY. Tampoco está permitido explotar de manera alguna el sitio/app ni ningún otro servicio o información disponible u ofrecida a través del mismo con el propósito de revelar información, incluyendo sin limitación, la identificación personal o la información que no sea propia facilitada por el sitio/app/app. Aceptas no llevar a cabo ninguna acción que provoque una saturación desproporcionada o innecesaria en la infraestructura del sitio/app o en los sistemas o redes de MUNILY. Aceptas no emplear ningún dispositivo, programa o rutina con el fin de tratar de interferir en el correcto funcionamiento del sitio/app/app o de cualquier transacción llevada a cabo en el mismo, así como tampoco en el uso que otras personas estén haciendo del sitio/app. No está permitido el uso del sitio/app/app ni de su contenido con fines ilegales o ilícitos según estas condiciones de uso. Tampoco está permitido encargar la realización de ninguna actividad ilegal o que infrinja los derechos de MUNILY o de terceros.

Incumplimiento de las condiciones de uso

Si lo considera oportuno, MUNILY podría revelar tus datos personales (incluida tu identidad) con el fin de llevar a cabo una investigación o reclamación derivada de tu uso del sitio/app, o bien para identificar, contactar o emprender medidas legales contra alguien que hubiera interferido o causado perjuicios (con intención o sin ella) a los derechos de propiedad de MUNILY o de los usuarios del sitio/app, incluidos los clientes de MUNILY. MUNILY se reserva el derecho a revelar en todo momento cualquier dato que sea requerido por los entes u organismos judiciales para cumplir con las leyes, normativas, procedimientos judiciales o solicitudes gubernamentales. Asimismo, MUNILY podría revelar tus datos si valora que la normativa vigente así lo requiere. Declaras comprender y aceptar que MUNILY podría conservar cualquier comunicación contigo o cualquier servicio prestado a través del mismo. Asimismo, MUNILY podría revelar estos datos si se le requiere legalmente o bien si considera que dicha conservación o revelación de datos es razonablemente necesaria con el fin de (1) cumplir con procedimientos judiciales, (2) ejecutar las presentes condiciones de uso, (3) responder ante demandas sobre la violación de dichos datos de los derechos de terceros, o (4) proteger los derechos, la propiedad o la seguridad de MUNILY, sus empleados, los usuarios o visitantes del sitio/app y el público. Si MUNILY emprende alguna acción legal contra ti como consecuencia del incumplimiento de las presentes condiciones de uso, tendrá derecho a que le abones los gastos de abogados y costes razonables que suponga dicha acción, además de cualquier otra indemnización que le corresponda. Aceptas que MUNILY no tenga ninguna responsabilidad ante ti ni ante ningún tercero respecto a la rescisión del acceso al sitio/app como consecuencia del incumplimiento de las condiciones de uso.

Términos y condiciones para grabación de comunicaciones en Propiedad Horizontal

Consentimiento Informado. Al aceptar estos Términos y Condiciones, el residente y/o propietario otorga su consentimiento informado para la grabación de las comunicaciones telefónicas realizadas por el guardia de seguridad en el contexto de la administración y seguridad de la propiedad horizontal.
Propósito de la Grabación. Las grabaciones de comunicaciones se llevarán a cabo exclusivamente con el propósito de garantizar la seguridad, control de acceso y administración adecuada en la propiedad horizontal.
Almacenamiento Seguro. Todas las grabaciones se almacenarán de manera segura y solo el administrador, residente y/o propietario accederá a ellas en situaciones que requieran la verificación de eventos o la resolución de problemas relacionados con la seguridad y administración de la propiedad.
Acceso Restringido. El acceso a las grabaciones estará restringido a personal encargado de la administración de la propiedad horizontal. No se compartirá la información con terceros fuera de la propiedad horizontal sin el consentimiento explícito del propietario/residente, a menos que sea requerido por la ley.
Retención de Datos. Las grabaciones se retendrán durante 8 meses para cumplir con los fines declarados y se eliminarán de manera segura cuando ya no sean requeridas.
Información Transparente. Se proporcionará información transparente y accesible sobre la práctica de grabación de las comunicaciones, incluyendo estos términos y condiciones, para garantizar la comprensión completa por parte del propietario y residente.
Cambios en los Términos. En caso de cambios en estos términos y condiciones, se notificará al propietario y residente de manera oportuna, y se solicitará su consentimiento si es necesario.

Términos y Condiciones para el Uso de Datos Biométricos en Reconocimiento Facial para Propiedades Horizontales

Propósito y Uso de Datos Biométricos Este sistema utiliza tecnología de reconocimiento facial para verificar la identidad de los visitantes que ingresan a propiedades horizontales. La finalidad del procesamiento de datos biométricos es exclusivamente para la seguridad y el control de acceso en dichas propiedades.
Consentimiento Informado Al aceptar estos términos, el visitante otorga consentimiento explícito para el uso de sus datos biométricos en el sistema de acceso. La información obtenida será empleada únicamente con fines de seguridad y control de acceso.
Administración y Almacenamiento de Datos Los datos biométricos serán gestionados y almacenados por la administración de la propiedad horizontal, autorizada por la Asamblea de Propietarios, conforme a las normativas locales de privacidad. Estos datos serán conservados solo durante el tiempo necesario para cumplir con los objetivos de seguridad y control de acceso, y no serán compartidos con terceros sin autorización previa.
Privacidad y Confidencialidad El manejo de los datos biométricos se realizará con estrictas medidas de seguridad y confidencialidad, protegiendo la información contra accesos no autorizados. Los datos no serán utilizados para ningún fin que no esté especificado en estos términos, ni se compartirán sin consentimiento explícito.
Información Visible y Avisos Las propiedades horizontales que implementen el sistema de reconocimiento facial deberán instalar un aviso informativo en un área visible, indicando que los datos biométricos de los visitantes serán utilizados únicamente para temas de seguridad y control de acceso.

Términos y condiciones adicionales para las compras

La moneda con la cual se procesarán todas las transacciones dentro del sitio/app es el dólar americano.

Las obligaciones de MUNILY, si las hubiera, con respecto a sus productos y servicios se rigen únicamente por los acuerdos según los cuales se venden o prestan, y nada puede inferirse del sitio/app para alterar tales acuerdos.

MUNILY puede aplicar cambios en los productos y servicios ofrecidos en el sitio/app, o en los precios aplicables a los mismos, en cualquier momento y sin previo aviso. Los materiales del sitio/app con respecto a los productos y servicios pueden estar desfasados, y MUNILY no se compromete a actualizarlos.

Cada una de estas políticas puede actualizarse cada cierto tiempo, en cuyo caso entrará en vigor de forma inmediata tras la publicación de los cambios en el sitio/app.

Habeas Data

Teniendo en cuenta el público objetivo de la aplicación, esto es, personas con una vinculación vigente a MUNILY, de manera enunciativa, administradores, guardas de seguridad, residentes e invitados, etc., el usuario entiende y acepta que la presente aplicación solicitará y utilizará sus datos personales, de acuerdo a las autorizaciones previamente otorgadas por el usuario, en el marco de la Ley 1581 de 2012, la demás normativa que la regule, modifique o derogue y al Manual de Políticas de Datos Personales de MUNILY el cual podrá ser consultado en la Página web: https://munily.com En caso de que el usuario ingrese los datos de un tercero, no vinculado a MUNILY, o a una copropiedad, manifiesta que tiene la autorización del mismo para generar este ingreso. MUNILY. únicamente tratará estos datos para los fines indicados al inicio. El usuario también acepta que MUNILY. puede recolectar su dirección IP para propósitos de administración de sistemas, para auditar tendencias del uso, desempeño y/o comportamiento de la aplicación en las condiciones establecidas en el aparte particular.

Responsabilidad de MUNILY.

MUNILY. procurará garantizar disponibilidad, continuidad o buen funcionamiento de la aplicación. MUNILY podrá bloquear, interrumpir o restringir el acceso a esta cuando lo considere necesario para el mejoramiento de la aplicación o por dar de baja de la misma. Se recomienda al Usuario tomar medidas adecuadas y actuar diligentemente al momento de acceder a la aplicación, como, por ejemplo, contar con programas de protección, antivirus, para manejo de malware, spyware y/o herramientas similares en los dispositivos desde donde se estén conectando al sistema. MUNILY no será responsable por: a) Fuerza mayor o caso fortuito; b) Por la pérdida, extravío o hurto de su dispositivo móvil que implique el acceso de terceros a la aplicación móvil; c) Por errores en la digitación o accesos por parte del cliente; d) Por los perjuicios, lucro cesante, daño emergente, morales, y en general sumas a cargo de MUNILY, por los retrasos, no procesamiento de información o suspensión del servicio del operador móvil o daños en los dispositivos móviles.

Denegación y retirada del acceso a la aplicación

En el Evento en que un Usuario incumpla estos Términos y Condiciones, o cualesquiera otras disposiciones que resulten de aplicación, MUNILY podrá suspender su acceso a la aplicación.

Términos y condiciones

MUNILY está comprometida en la protección de la seguridad de su información. MUNILY tiene implementados mecanismos de seguridad que aseguran la protección de la información personal, así como los accesos únicamente al personal y sistemas autorizados, también contra la pérdida, uso indebido y alteración de sus datos de usuario bajo nuestro control. Excepto como se indica en el presente, sólo personal autorizado tiene acceso a la información que nos proporciona. Además, hemos impuesto reglas estrictas a los empleados de MUNILY con acceso a las bases de datos que almacenan información del usuario o a los servidores que hospedan nuestros servicios.

TERMS AND CONDITIONS FOR THE USE OF THE MUNILY APP

Regulations for the use of the mobile application.

This document establishes the conditions by which the use of the mobile application: Munily's web, whose domain is http://www.munily.com , to all its related or linked sites/apps from http://www.munily.com (hereinafter the application), which is operated by TECHNOLOGY SOLUTIONS S.A., a company duly registered in Folio 155652812, of the Microfilm Section (Mercantile) of the Public Registry of Panama, hereinafter MUNILY. The user agrees to read the terms and conditions set forth herein and by accepting them it is understood that he/she has full knowledge of this document and all of its stipulations. The user acknowledges that the entry of his personal information, and the data contained in the application at his disposal regarding his information and other personal data, is done voluntarily, those who choose to access this application do so on their own initiative and are responsible for compliance with local laws, to the extent that such laws are applicable in their respective country.

Authorized use of the application

The application is intended to serve as a platform for the management and administration of co-ownerships, interconnecting administrators, security guards, residents and guests to provide security and community communication solutions. Unless otherwise explicitly stated in these terms of use, you may not copy, reproduce, republish, upload, post, publicly display, encode, translate, transmit or distribute in any way any part or content of the site/app to any other computer, server, web page or other medium for publication or distribution without the prior written consent of MUNILY.

Scope and use

The user of the application understands and accepts that, notwithstanding, it is operated by MUNILY, the information contained in the same will be the one referring to its contractual link with each co-ownership, therefore, the functionalities offered by the application will be delivered to each user according to its link with the condominium. The application will make available to the user information and/or will allow the execution of the transactions determined or enabled by the condominium according to the type of user. MUNILY may update, add, modify or eliminate the functionalities at any time, which the user accepts by installing the application. In any case, at the time of such modifications, the user will be notified through the same mobile application once logged in and the user may decide whether to continue enjoying the services of MUNILY accepting the new terms and conditions applicable. The response times, procedures and other requests made by the user through the application will be processed in accordance with the specifications of each active service in each condominium. The user accepts and authorizes that the electronic records of the aforementioned activities carried out in the application constitute full proof of the same.

Requirements for use

The user must have an intelligent mobile device (Smartphone) or Tablet with Android or IOS operating system, any of these with internet access, both secure and reliable. MUNILY will not be responsible for the security of the Smartphone devices owned by the users used to access the channel, nor for the availability of the service in the devices in which the application is downloaded. To the extent permitted by law, the application materials are provided without warranty of any kind, express or implied, including without limitation warranties of satisfactory quality, merchantability, fitness for a particular purpose or non-infringement, therefore, MUNILY does not guarantee proper operation on the various operating systems or devices on which the application is used. To access the application, the user will use his/her email and password, which identifies him/her in his/her relationship with the condominium. In addition to the above, the double authentication factor implemented by MUNILY will be required.

Obligations of users

The User undertakes to use the application and the contents found therein in a diligent, correct and lawful manner and, in particular, undertakes NOT to engage in the conduct described below:

Use the contents in a manner, with purposes or effects contrary to law, morality and generally accepted good customs or public order;
Reproduce, copy, represent, use, distribute, transform or modify the contents of the application, by any process or on any support, in whole or in part, or allow public access through any form of public communication;
Use the contents in any way that entails a risk of damage or disablement of the application or the contents or third parties;
Suppress, evade or manipulate the copyright and other data identifying the copyright incorporated to the contents, as well as the technical protection devices, or any information mechanisms that the contents may have;
Use the contents and, in particular, the information obtained through the application to distribute, transmit, forward, modify, refuse or report advertising or the contents thereof for the purpose of direct sale or any other commercial purpose, unsolicited messages addressed to a number of persons regardless of their purpose, as well as to market or disclose in any way such information;
Allow third parties to use the mobile application by sharing your username and password;
Use the application and the contents for lawful and/or unlawful purposes, contrary to the provisions of these Terms and Conditions, or to the use of the application itself, that are harmful to the rights and interests of third parties, or that in any way may damage, disable, overburden or impair the application and the contents or prevent the normal use or enjoyment of this and the contents by the users.

Intellectual Property

All computer, graphic, advertising, photographic, multimedia, audiovisual and design material, as well as all contents, texts and databases made available in this application are protected by copyright and/or industrial property rights owned by MUNILY or by third parties who have authorized their use or exploitation by MUNILY, or their use is expressly authorized by law. All the contents of the application are protected by the rules on copyright and by all applicable national and international regulations. Except as expressly provided in these Terms and Conditions, any act of copying, reproduction, modification, creation of derivative works, sale or distribution, display of the contents of this application, in any manner or by any means, including, but not limited to, electronic, mechanical, photocopying, recording or otherwise, without the prior written permission of MUNILY or the owner of the respective rights, is prohibited. In no event do these Terms and Conditions confer any rights, licenses or authorizations to do any of the foregoing prohibited acts. Any unauthorized use of the contents will constitute a violation of this document and of the current regulations on copyrights, the current national and international regulations on Industrial Property, and any other applicable regulations.

License to copy for personal use

You may read, view, print and download your product material. No part of the application may be reproduced, transmitted or stored in any other website or other form of electronic retrieval system. Whether specifically acknowledged or not, the trademarks, service marks and logos displayed in this application belong to MUNILY, or authorized third parties. MUNILY does not interfere with, make any decisions about, or guarantee any relationships that users may enter into or dealings with third parties that advertise and/or promote its products and services. These third party trademarks are used solely to identify the products and services of their respective owners and sponsorship or endorsement by MUNILY should not be inferred from the use of these trademarks.

Site/app usage

The use of robots, spiders or other automatic devices, programs, algorithms, methodologies or similar manual processes to access, acquire, copy or track portions of the site/app or its content in order to obtain or attempt to obtain materials, documents or information not available through the site/app is prohibited. MUNILY reserves the right to prohibit any such activity. It is prohibited to scan, scan or assess the vulnerability of the site/app or any network connected to it, or to breach the security or authentication measures of the site/app or any network connected to it. It is not allowed to track or search for data of users, visitors to the site/app or other MUNILY customers. You agree not to employ any device, program or routine for the purpose of attempting to interfere with the proper working of the site/app/app or any transaction being conducted on the site/app, or with any other person's use of the site/app. You may not use the site/app/app or its content for any purpose that is unlawful or illegal under these terms of use. You may not engage in any activity that is unlawful or infringes the rights of MUNILY or any third party.

Non-compliance with conditions of use

MUNILY may disclose your personal information (including your identity) in order to conduct an investigation or complaint regarding your use of the site/app, or to identify, contact or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) MUNILY's property rights or the property rights of users of the site/app, including MUNILY's customers. MUNILY reserves the right at all times to disclose any information as required by law or law enforcement agencies to comply with any law, regulation, legal process or governmental request. MUNILY may also disclose your information if MUNILY believes that applicable law requires it. You agree to understand and accept that MUNILY may retain any communication with you or any service provided through it. MUNILY may also disclose such data if it is legally required to do so or if it believes that such retention or disclosure is reasonably necessary to (1) comply with legal process, (2) enforce these Terms of Use, (3) respond to claims that such data violates the rights of third parties, or (4) protect the rights, property or safety of MUNILY, its employees, users of or visitors to the site/app and the public. If MUNILY takes any legal action against you as a result of your violation of these Terms of Use, MUNILY shall be entitled to recover from you all reasonable attorneys' fees and costs of such action, in addition to any other relief it may be entitled to. You agree that MUNILY shall have no liability to you or any third party for termination of your access to the site/app as a result of your breach of these terms of use.

Terms and conditions for recording communications in Condominium Property

Informed Consent. By accepting these Terms and Conditions, the resident and/or owner grants his/her informed consent to the recording of telephone communications made by the security guard in the context of the administration and security of the condominium.
Purpose of Recording. Recordings of communications shall be made exclusively for the purpose of ensuring security, access control and proper management of the Condominium.
Secure Storage. All recordings will be securely stored and will only be accessed by the manager, resident and/or owner in situations requiring verification of events or resolution of issues related to security and property management.
Restricted Access. Access to the recordings will be restricted to personnel in charge of the management of the condominium. The information will not be shared with third parties outside the condominium without the explicit consent of the owner/resident, unless required by law.
Data Retention. Recordings will be retained for 8 months to fulfill the stated purposes and will be securely deleted when no longer required.
Transparent Information. Transparent and accessible information about the practice of recording communications, including these terms and conditions, shall be provided to ensure full understanding by the owner and resident.
Changes to Terms. In the event of changes to these terms and conditions, the owner and resident will be notified in a timely manner, and their consent will be sought if necessary.

Terms and Conditions for the Use of Biometric Data in Facial Recognition for Horizontal Properties

Purpose and Use of Biometric Data This system uses facial recognition technology to verify the identity of visitors entering horizontal properties. The purpose of biometric data processing is exclusively for security and access control in such properties.
Informed Consent By accepting these terms, the visitor gives explicit consent to the use of his/her biometric data in the access system. The information obtained will be used only for security and access control purposes.
Data Management and Storage Biometric data will be managed and stored by the management of the condominium, authorized by the Assembly of Owners, in accordance with local privacy regulations. This data will be kept only for the time necessary to meet security and access control purposes, and will not be shared with third parties without prior authorization.
Privacy and Confidentiality The handling of biometric data will be carried out with strict security and confidentiality measures, protecting the information against unauthorized access. The data will not be used for any purpose not specified in these terms, nor will it be shared without explicit consent.
Visible Information and Notices Horizontal properties that implement the facial recognition system shall install an informative notice in a visible area, indicating that the biometric data of visitors will be used only for security and access control purposes.

Additional terms and conditions for purchases

The currency in which all transactions within the site/app will be processed is the US dollar.

MUNILY's obligations, if any, with respect to its products and services are governed solely by the agreements pursuant to which they are sold or provided, and nothing may be inferred from the site/app to alter such agreements.

MUNILY may make changes to the products and services offered on the site/app, or to the prices applicable thereto, at any time without notice. The materials on the site/app with respect to products and services may be out of date, and MUNILY makes no commitment to update the materials on the site/app.

Each of these policies may be updated from time to time, in which case it will be effective immediately upon posting of the changes on the site/app.

Habeas Data

Taking into account the target audience of the application, i.e. people with a current relationship with MUNILY, including, but not limited to, administrators, security guards, residents and guests, etc., the user understands and accepts that the present application will request and use his/her personal data, according to the authorizations previously granted by the user, within the framework of Law 1581 of 2012, the other regulations that regulate, modify or repeal it and the Manual of Personal Data Policies of MUNILY which can be consulted in the Web Page: https://munily.com In case the user enters the data of a third party, not linked to MUNILY, or to a co-ownership, he/she declares that he/she has the authorization of the same to generate this entry. MUNILY. will only process this data for the purposes indicated at the beginning. The user also accepts that MUNILY. may collect his/her IP address for system administration purposes, to audit trends in the use, performance and/or behavior of the application under the conditions established in the particular section.

Responsibility of MUNILY.

MUNILY will try to guarantee the availability, continuity or proper functioning of the application. MUNILY may block, interrupt or restrict access to the application when it deems it necessary for the improvement of the application or for its termination. The User is recommended to take adequate measures and act diligently when accessing the application, such as, for example, having protection programs, antivirus, malware, spyware and/or similar tools on the devices from which they are connecting to the system. MUNILY shall not be liable for: a) Force majeure or acts of God; b) Loss, misplacement or theft of your mobile device that implies access by third parties to the mobile application; c) Errors in typing or access by the client; d) Damages, loss of profits, consequential damages, moral damages, and in general amounts payable by MUNILY, due to delays, non-processing of information or suspension of the mobile operator's service or damage to the mobile devices.

Denial and withdrawal of access to the application

In the event that a User breaches these Terms and Conditions, or any other applicable provisions, MUNILY may suspend the User's access to the application.

Terms and Conditions

The User expressly accepts the Terms and Conditions, being an essential condition for the use of the application. In the event that you find yourself in disagreement with these Terms and Conditions, please leave the application immediately. MUNILY may modify these Terms and Conditions, notifying the users of the application through publication on the web page: https://munily.com, by disseminating the modifications through the application, by any electronic means, social networks, SMS and/or email, which will be understood as accepted by the user if he/she continues with the use of the application.

Jurisdiction

These terms and conditions and everything related to this application are governed by the laws of the Republic of Panama.

Security and Confidentiality

MUNILY is committed to protecting the security of your information. MUNILY has security mechanisms in place to ensure the protection of personal information and access only to authorized personnel and systems, as well as against the loss, misuse and alteration of your user data under our control. Except as stated herein, only authorized personnel have access to the information you provide to us. In addition, we have imposed strict rules on MUNILY employees with access to databases that store user information or to servers that host our services.
