CONTENIDO DE LA POLÍTICA DE TRATAMIENTO
CAPITULO I
DATOS GENERALES DE MUNILY S.A.S.

OBJETIVO DE LA POLÍTICA DE TRATAMIENTO
Con el objetivo de dar cumplimiento a la legislación vigente en materia de protección de datos, en especial la Ley 1581 de 2012 y al Decreto 1377 de 2013 (y demás normas que los modifiquen, adicionen, complementen o desarrollen), a continuación señalamos los aspectos relevantes en relación con la recolección, uso y transferencia de datos personales que MUNILY S.A.S. en Colombia (en adelante MUNILY), realiza de los datos personales, en virtud de la autorización que haya sido otorgada para dicho tratamiento.. En esta política de tratamiento de datos personales (la “Política”) se encuentran los lineamientos corporativos y de ley, bajo los cuales MUNILY realiza el tratamiento de los datos personales, la finalidad, los derechos de los titulares, así como los procedimientos internos y externos que existen para el ejercicio de tales derechos ante la Compañía, entre otros: Conforme a lo previsto en el artículo 15 de la Constitución Política de Colombia y la legislación aplicable (Ley 1266 de 2008, Ley 1581 de 2012, Decreto 1377 de 2013 y todas aquellas normas que las reglamenten, adicionen, deroguen o modifiquen), en MUNILY tenemos una clara política de privacidad y protección de datos personales que incluye a profesionales independientes, clientes, proveedores, empleados que tengan una relación comercial o jurídica con el Grupo MUNILY y que hayan suministrado voluntariamente su consentimiento previo, expreso e informado CAPITULO III
ANTECEDENTES DE LA POLÍTICA DE TRATAMIENTO
Los sucesos que anteceden la elaboración y divulgación de la presente Política de Tratamiento de Datos Personales son aquellos que se exponen a continuación: - Mediante la Ley 1581 de Octubre 17 de 2012 se expidió el Régimen General de Protección de Datos Personales, el cual, de conformidad con su artículo 1°, tiene por objeto: (…) desarrollar el derecho constitucional que tienen todas las personas a conocer, actualizar y rectificar las informaciones que se hayan recogido sobre ellas en bases de datos o archivos, y los demás derechos, libertades y garantías constitucionales a que se refiere el artículo 15 de la Constitución Política; así como el derecho a la información consagrado en el artículo 20 de la misma”.
- La Ley 1581 de 2012 constituye el marco general de la protección de los datos personales en Colombia.
- Mediante Sentencia C-748 del 6 de octubre de 2011 la Corte Constitucional declaró exequible el Proyecto de Ley Estatutaria No. 184 de 2010 – Senado, 046 de 2010 -Cámara.
- Mediante Decreto 1377 de Junio 27 de 2013, el Ministerio de Comercio, Industria y Turismo reglamentó aspectos relacionados con la autorización del Titular de información para el Tratamiento de sus datos personales, las políticas de Tratamiento de los Responsables y Encargados, el ejercicio de los derechos de los Titulares de información, las transferencias de datos personales y la responsabilidad demostrada frente al Tratamiento de datos personales, este último tema referido a la rendición de cuentas.
- Mediante Decreto 1074 de 2015, capitulo 25 se reglamenta parcialmente la Ley 1581 de 2012 y el capítulo 26 el Registro Nacional de Bases de Datos.
- Circular 002 del 3 de noviembre de 2015 emitida por la Superintendencia de Industria y Comercio, con la cual se habilita el Registro Nacional de Bases de Datos.
CAPITULO IV
A QUIÉN SE DIRIGE LA POLÍTICA DE TRATAMIENTO
La presente Política de Tratamiento de Datos Personales está dirigida a Clientes y potenciales clientes, Proveedores, Empleados de MUNILY, tanto activos como inactivos, administradores, guardas de seguridad, residentes e invitados de copropiedades cuyos datos personales se encuentran incluidos en las Bases de Datos de la Compañía. CAPITULO V
DEFINICIONES RELEVANTES DE LA POLÍTICA DE TRATAMIENTO
Para la interpretación de esta Política, se deben tener en cuenta las siguientes definiciones: - Aviso de Privacidad: Comunicación verbal o escrita generada por el Responsable, dirigida al Titular para el Tratamiento de sus datos personales, mediante la cual se le informa acerca de la existencia de las políticas de Tratamiento de información que le serán aplicables, la forma de acceder a las mismas y las finalidades del Tratamiento que se pretende dar a los datos personales.
- Titular: Toda persona que, como destinatario final, ya sea de los servicios de MUNILY o ejerciendo como profesionales independientes, trabajadores, Clientes, y potenciales clientes, Proveedores, Empleados de MUNILY, administradores, guardas de seguridad, residentes e invitados de copropiedades, tanto activos como inactivos y demás personas en general.
- Dato Personal: Cualquier información vinculada o que pueda asociarse a una o varias personas naturales determinadas o determinables.
- Datos Sensibles: Aquellos datos que afectan la intimidad del Titular o cuyo uso indebido puede generar su discriminación.
- Empleado: Persona natural que en virtud de un contrato de trabajo se obliga a prestar un servicio personal a otra persona natural o jurídica, bajo la continuada dependencia o subordinación de la segunda y mediante remuneración.
- Encargado del Tratamiento: Persona natural o jurídica, pública o privada, que por sí misma o en asocio con otros, realice el Tratamiento de datos personales por cuenta de MUNILY como Responsable de los datos.
- Política de Tratamiento: Se refiere al presente documento, como política de tratamiento de datos personales aplicada por MUNILY de conformidad con los lineamientos de la legislación vigente en la materia.
- Proveedor: Toda persona natural o jurídica que preste algún servicio a MUNILY en virtud de una relación contractual / obligacional.
- Responsable del Tratamiento: Persona natural o jurídica, pública o privada, que por sí misma o en asocio con otros, decida sobre la base de datos y/o el Tratamiento de los Datos, para efectos de esta política, ejercerá como Responsable, en principio, MUNILY.
- Transferencia: Se refiere al envío por parte de MUNILY como responsable del Tratamiento o un Encargado de los datos, a un tercer agente o persona natural /jurídica (receptor), dentro o fuera del territorio nacional para el tratamiento efectivo de datos personales.
- Trasmisión: Se refiere a la comunicación de datos personales por parte del Responsable al Encargado, ubicado dentro o fuera del territorio nacional, para que el Encargado, por cuenta del Responsable, trate datos personales.
- Tratamiento: Cualquier operación o conjunto de operaciones sobre datos personales, tales como la recolección, almacenamiento, uso, circulación o supresión.
Para el entendimiento de los términos que no se encuentran incluidos dentro del listado anterior, se deberá remitir a la legislación vigente, en especial a la Ley 1581 de 2012 y al Decreto 1377 de 2013 y o a aquellas que complemente, adiciones y/o modifiquen la legislación vigente al respecto. Adicionalmente, en caso de duda sobre una cualquiera de las definiciones aquí previstas, se le deberá dar a la misma el sentido que ha sido empleado por el legislador en las normas anteriormente citadas CAPITULO VI
PRINCIPIOS PARA EL TRATAMIENTO DE DATOS PERSONALES
Los principios que rigen el Tratamiento de Datos Personales por parte de MUNILY, son los siguientes: - Principio de Legalidad en materia de tratamiento de datos: El Tratamiento a que se refiere la Ley 1581 de 2012 es una actividad reglada que debe sujetarse a lo establecido en ella y en las demás disposiciones que la desarrollen.
- Principio de Finalidad El Tratamiento de los datos personales debe obedecer a una finalidad legítima de acuerdo con la Constitución y la Ley, la cual debe ser informada al Titular.
- Principio de Libertad: El Tratamiento de los datos personales sólo puede ejercerse con el consentimiento, previo, expreso e informado del Titular. Los datos personales no podrán ser obtenidos o divulgados sin previa autorización, o en ausencia de mandato legal o judicial que releve el consentimiento.
- Principio de Veracidad o Calidad La información sujeta a Tratamiento debe ser veraz, completa, exacta, actualizada, comprobable y comprensible. Se prohíbe el Tratamiento de datos parciales, incompletos, fraccionados o que induzcan a error.
- Principio de Transparencia: En el Tratamiento debe garantizarse el derecho del Titular a obtener del Responsable del Tratamiento o del Encargado del Tratamiento, en cualquier momento y sin restricciones, información acerca de la existencia de datos que le conciernan.
- Principio de Acceso y Circulación Restringida: El Tratamiento se sujeta a los límites que se derivan de la naturaleza de los datos personales, de las disposiciones de la ley y la Constitución. En este sentido, el Tratamiento sólo podrá hacerse por personas autorizadas por el Titular y/o por las personas previstas en la ley.
Los datos personales, salvo la información pública, no podrán estar disponibles en Internet u otros medios de divulgación o comunicación masiva, salvo que el acceso sea técnicamente controlable para brindar un conocimiento restringido sólo a los Titulares o terceros autorizados conforme a la ley. - Principio de Seguridad: La información sujeta a Tratamiento por el Responsable del Tratamiento o Encargado del Tratamiento, se deberá manejar con las medidas técnicas, humanas y administrativas que sean necesarias para otorgar seguridad a los registros evitando su adulteración, pérdida, consulta, uso o acceso no autorizado o fraudulento.
- Principio de Confidencialidad: Todas las personas que intervengan en el Tratamiento de datos personales que no tengan la naturaleza de públicos están obligadas a garantizar la reserva de la información, inclusive después de finalizada su relación con alguna de las labores que comprende el Tratamiento, pudiendo sólo realizar suministro o comunicación de datos personales cuando ello corresponda al desarrollo de las actividades autorizadas en la ley y en los términos de la misma.
CAPITULO VII
AUTORIZACIÓN DEL TITULAR PARA EL TRATAMIENTO DE DATOS
MUNILY como Responsable del Tratamiento ha adoptado procedimientos para solicitar, a más tardar en el momento de la recolección de los datos personales, la correspondiente autorización para el Tratamiento de los mismos e informar cuáles son los datos personales que serán recolectados, así como todas las finalidades específicas del Tratamiento para las cuales se obtiene el consentimiento. Sin embargo, tratándose de datos personales que se encuentren en fuentes de acceso público, con independencia del medio por el cual se tenga acceso, entendiéndose por tales aquellos datos o bases de datos que se encuentren a disposición del público, se tiene que éstos pueden ser tratados por MUNILY, siempre y cuando, por su naturaleza, sean datos públicos. MUNILY como Responsable del Tratamiento de datos personales ha establecido mecanismos para obtener la autorización de los Titulares o de quien se encuentre legitimado para tal efecto. Se entenderá que la autorización otorgada por el Titular a MUNILY, cumple con los requisitos exigidos en la legislación vigente aplicable, cuando ésta se manifieste: (i) por escrito; (ii) de forma oral; o (iii) mediante conductas inequívocas del Titular que permitan concluir de forma razonable que éste otorgó a MUNILY la autorización respectiva. En ningún caso el silencio de los titulares del dato para emitir su consentimiento o autorización será asimilado por MUNILY como una conducta inequívoca. Los Titular de datos personales pueden en todo momento solicitar a MUNILY como Responsable del Tratamiento, la supresión de sus datos personales y/o revocar la autorización que le fue otorgada a MUNILY para el Tratamiento de los datos, para lo cual se han habilitado los canales previstos en el Numeral 3° del Capítulo Décimo Segundo de la presente Política. CAPITULO VIII
AUTORIZACIÓN DEL TITULAR PARA EL TRATAMIENTO DE DATOS SENSIBLES
De acuerdo con lo previsto en el Capítulo V de la presente Política, se entiende por Datos Sensibles: “aquellos datos que afectan la intimidad del Titular o cuyo uso indebido puede generar su discriminación”. El tratamiento de los datos sensibles a los cuales se refiere el Artículo 5° de la Ley 1581 de 2012 está prohibido, a excepción de los casos que a continuación se relacionan: - Cuando el Titular haya dado su autorización explícita a dicho Tratamiento, salvo en los casos que por ley no sea requerido el otorgamiento de dicha autorización.
- Cuando el Tratamiento sea necesario para salvaguardar el interés vital del Titular y este se encuentre física o jurídicamente incapacitado. En estos eventos, los representantes legales deberán otorgar su autorización.
- Cuando el Tratamiento sea efectuado en el curso de las actividades legítimas y con las debidas garantías por parte de una fundación, ONG, asociación o cualquier otro organismo sin ánimo de lucro, cuya finalidad sea política, filosófica, religiosa o sindical, siempre que se refieran exclusivamente a sus miembros o a las personas que mantengan contactos regulares por razón de su finalidad. En estos eventos, los datos no se podrán suministrar a terceros sin la autorización del Titular.
- Cuando el Tratamiento se refiera a datos que sean necesarios para el reconocimiento, ejercicio o defensa de un derecho en un proceso judicial;
- Cuando el Tratamiento tenga una finalidad histórica, estadística o científica. En este evento deberán adoptarse las medidas conducentes a la supresión de identidad de los Titulares.
En el Tratamiento de datos personales sensibles, cuando dicho Tratamiento sea posible conforme a lo establecido en el Artículo 6 de la Ley 1581 de 2012, MUNILY cumple las siguientes obligaciones: - Informa al Titular que por tratarse de datos sensibles no está obligado a autorizar su Tratamiento.
- Informa al Titular de forma explícita y previa, además de los requisitos generales de la autorización para la recolección de cualquier tipo de dato personal, cuáles de los datos que serán objeto de Tratamiento son sensibles y la finalidad de su Tratamiento, y además obtiene su consentimiento expreso.
Ninguna de las actividades que realiza MUNILY está ni estará condicionada a que los titulares de datos suministren a la Compañía datos personales sensibles. CAPITULO IX
USO Y FINALIDAD DEL TRATAMIENTO
MUNILY reconoce que los Titular de datos personales tiene derecho a contar con una expectativa razonable de su privacidad, teniendo en todo caso para ello en cuenta sus responsabilidades, derechos y obligaciones con la Compañía. MUNILY utilizará los datos personales recolectados con las siguientes finalidades: - Ejecutar los contratos que se tienen suscritos con los clientes.
- Para brindar soluciones de seguridad y comunicación comunitaria en propiedades horizontales.
- Realizar el pago de las obligaciones contractuales.
- Enviar la información a entidades gubernamentales o judiciales por solicitud expresa de las mismas.
- Soportar procesos de auditoría externa e interna.
- Realizar el pago de nómina, expedición de certificaciones laborales, invitaciones a eventos de la compañía a sus trabajadores activos.
- Expedición de certificados laborales solicitados por trabajadores que se hayan retirado de la empresa.
- Desarrollar campañas de comunicación internas que puedan contender datos de los empleados de MUNILY en Colombia.
- Contactar a profesionales independientes, trabajadores, cliente y proveedores, para el envió de información comercial que pueda ser solicitada o que tenga que ver con la relación contractual entre las partes.
- Contactar profesionales que envíen sus hojas de vida para realizar entrevistas de trabajo.
- Presentación de propuestas que sean solicitadas ya sea electrónicamente, por escrito o por medios electrónicos.
- Envío de correos electrónicos contentivos de boletines, publicaciones, invitaciones a eventos e información que pueda ser relevante para los clientes y/o prospectos
- Envío de propuestas y portafolio de servicios.
- Envío de encuestas de satisfacción y programas de mejora del servicio (solo para clientes).
La información proporcionada por los Titulares de datos personales será utilizada por MUNILY sólo para los propósitos aquí señalados, y, por tanto, no procederemos a vender, licenciar, transmitir o divulgar la misma, fuera de la Compañía, salvo que: (i) usted nos autorice expresamente a hacerlo; (ii) sea necesario hacerlo para permitir a nuestros profesionales, prestar nuestros servicios; (iii) sea requerido o permitido por la ley o por una autoridad administrativa o judicial competente. A fin de poner en práctica los propósitos descritos anteriormente, sus datos personales podrán ser divulgados con los fines dispuestos anteriormente al personal que conforma la Gerencia de Talento Humano, Gerencia Administrativa y Financiera y Gerencia Comercial. MUNILY podrá subcontratar a terceros para el procesamiento de determinadas funciones o información. Cuando efectivamente subcontratamos con terceros el procesamiento de la información personal o proporcionamos información personal a terceros prestadores de servicios, advertimos a dichos terceros sobre la necesidad de proteger dicha información personal con medidas de seguridad apropiadas, les prohibimos el uso de su información personal para fines propios y les impedimos la divulgación de la información personal a otros. Una vez cese la necesidad de tratamiento de los datos, los mismos podrán ser eliminados de las bases de datos de MUNILY o archivados en términos seguros a efectos de que solamente sean divulgados cuando a ello hubiere lugar de acuerdo con la ley. CAPITULO X
TRATAMIENTO DE DATOS PERSONALES
La presente Política de Seguridad se extiende y da alcance a las diversas áreas que hacen parte del tratamiento (uso, recolección, circulación, almacenamiento y supresión) de datos personales; lo anterior con el fin de homogenizar procedimientos en la gestión y administración de riesgos en el tratamiento de datos personales. Esta Política de Seguridad se aplica a todas las Bases de Datos de MUNILY que contienen datos personales, ya sean estas digitales o físicas y vincula a cada una de las áreas y personal designado para el tratamiento de datos personales. La política se hará extensiva en lo aplicable a los encargados del tratamiento con quienes MUNILY establezca vínculos en lo que resulte aplicable Este documento aplica a todos los trabajadores, contratistas y personal vinculado a MUNILY en virtud de cualquier tipo de relación contractual y que intervenga en el tratamiento de datos personales en virtud de desarrollo del contrato Para el efecto se entenderá como dato personal cualquier información vinculada o que pueda asociarse a personas naturales. Para considerarlo como dato personal debe responder afirmativamente a la siguiente pregunta ¿Con el dato puedo identificar directa o directamente a una persona natural? De acuerdo al Decreto 1377 de 2013, MUNILY, sólo podrá recolectar, almacenar, usar o circular los datos personales de una persona, durante el tiempo que sea razonable y necesario, de acuerdo con las finalidades que justificaron el tratamiento, atendiendo a las disposiciones aplicables a la materia de que se trate y a los aspectos administrativos, contables, fiscales, jurídicos e históricos de la información. Una vez cumplida la o las finalidades del Tratamiento y sin perjuicio de normas legales que dispongan lo contrario MUNILY deberá proceder a la supresión de los datos personales que tenga en su posesión. Como excepción a lo anterior, MUNILY podrá conservar los datos personales cuando así se requiera para el cumplimiento de una obligación legal o contractual. En los casos en que MUNILY trate datos sensibles, definido como todo dato que afecta la intimidad del titular o cuyo uso indebido puede generar su discriminación, éstos serán protegidos conforme al marco y limitaciones establecidas por la Ley. MUNILY propenderá por darle cumplimiento a las medidas de seguridad digitales y físicas aquí establecidas, las cuales son adecuadas para velar por la seguridad de los datos sensibles. Así entonces, todo tratamiento (uso, recolección, circulación, almacenamiento y archivo) del dato personal, debe contar con autorización por parte del titular según las finalidades señaladas por el responsable. Por tanto, es deber de MUNILY velar porque las áreas que intervengan en todo el ciclo de vida del dato cumplan con lo dispuesto en la política de tratamiento y se dé el efectivo uso al dato personal según las finalidades autorizadas por el titular. TRATAMIENTO DE DATOS PERSONALES DE MENORES.
El tratamiento de datos de menores se debe sujetar a los principios, parámetros y requisitos contenidos en el Artículo 7º de la Ley 1581 de 2012, el Artículo 12 del Decreto 1377 de 2013 y la Sentencia C-778 de 2012 de la Corte Constitucional.
- El tratamiento de los datos personales de los menores de 18 años, pueden ser objeto de tratamiento siempre y cuando el fin que se persiga responda al interés superior de los niños, las niñas y adolescentes y se asegure sin excepción alguna el respeto de sus derechos prevalentes. De conformidad con lo anterior, será posible de manera excepcional el tratamiento de datos personales de los niños, niñas y adolescentes cuando se cumplan los siguientes criterios:
- La finalidad del tratamiento responda al interés superior de los niños, niñas y adolescentes.
- Se asegure el respeto de los derechos fundamentales de los niños, niñas y adolescentes
- De acuerdo con la madurez del niño, niña o adolescente se tenga en cuenta su opinión.
- Se cumpla con los requisitos previstos en la Ley 1581 de 2012 para el tratamiento de datos personales.
- Se obtenga autorización previa otorgada por el representante legal del menor, quienes generalmente son los padres.
VIDEOVIGILANCIA
Mediante la app Munily se podrán captar la imagen de las personas y vehículos que ingresan a las copropiedades que utilizan la app Munily, quienes previamente al ingreso son informadas de dicha situación por las personas encargadas de la recepción, quienes adicionalmente buscarán en ese momento la autorización del titular. La finalidad de estos sistemas tiene como único propósito la seguridad tanto de las personas que ingresan a la propiedad horizontal como de sus residentes
POLÍTICAS DEL ENCARGADO DE TRATAMIENTO DE DATOS PERSONALES
Se le llama ENCARGADO a aquel que realiza el tratamiento de los datos personales por cuenta de MUNILY, es decir, a quien MUNILY le está encomendando el manejo de un compendio de datos personales, ya sean entregados directamente por los titulares del dato o por terceros a MUNILY. En este sentido los datos personales entregados por parte de MUNILY deberán ser usados únicamente para el encargo encomendado y de conformidad con los lineamientos establecidos
Según la normatividad colombiana aplicable a la protección de datos personales y la jurisprudencia relacionada con el tema, el responsable del tratamiento del dato personal, es decir MUNILY y EL ENCARGADO del tratamiento, responden concurrente y solidariamente frente al titular del dato personal. Lo anterior frente a la veracidad, integridad, finalidad e incorporación del dato personal, así como en el tratamiento (uso, recolección, almacenamiento, circulación y supresión) del mismo; en el entendido que cualquier uso debe hacerse con autorización del titular.
En virtud de lo anterior, EL ENCARGADO se compromete con MUNILY a verificar el estado de entrega de los datos personales, así como ofrecer las medidas de seguridad necesarias para velar por la seguridad del dato según las medidas de la presente Política de Seguridad. Es deber del ENCARGADO prestar la mayor diligencia en la ejecución de su labor respecto de la protección y seguridad del dato personal, tanto en bases de datos digitales como físicas.
EL ENCARGADO responde por el uso, custodia y protección de los datos personales entregados por MUNILY, razón por la cual responderá hasta por culpa levísima respecto de la protección y custodia de los datos personales otorgados. Cualquier conducta contraria a las políticas aquí establecidas o su omisión, comprometerá la responsabilidad del ENCARGADO.
EL ENCARGADO deberá cumplir con los deberes consagrados en la Política del Encargado y con los demás deberes que establece el artículo 18 de la Ley 1581 de 2012 y así mismo, deberá responderá hasta por sus empleados o contratistas.
CAPITULO XI
REVOCATORIA DE LA AUTORIZACIÓN Y/O SUPRESIÓN DEL DATO
Los Titulares de datos pueden en todo momento solicitar a MUNILY como Responsable del Tratamiento, la supresión de sus datos personales y/o revocar la autorización que le ha otorgado para el Tratamiento de los mismos, mediante la presentación de un reclamo, de acuerdo con lo establecido en el artículo 15 de la Ley 1581 de 2012. Sin embargo, es importante tener en cuenta que la solicitud de supresión de la información y la revocatoria de la autorización no procederá cuando como Titular de los datos tenga un deber legal o contractual en virtud del cual deba permanecer en la base de datos de MUNILY. MUNILY ha dispuesto mecanismos de fácil acceso y gratuitos, para que los Titulares de los datos presenten en cualquier momento solicitudes de supresión de sus datos o revocatoria de la autorización otorgada. Dichos mecanismos se encuentran enunciados en el numeral 3° del Capítulo XIII del presente documento. Si vencido el término legal respectivo, MUNILY como Responsable no elimina los datos personales de sus bases de datos, el Titular podrá solicitar a la Superintendencia de Industria y Comercio que ordene la revocatoria de la autorización y/o la supresión de los datos personales. Para estos efectos se aplicará el procedimiento descrito en el artículo 22 de la Ley 1581 de 2012. Finalmente, es importante resaltar que, los datos personales serán conservados en las bases de datos de MUNILY cuando así se requiera en cumplimiento de una obligación legal o contractual. CAPITULO XII
DERECHOS DE LOS TITULARES DE LOS DATOS
De conformidad con lo establecido en el Artículo 8 de la Ley 1581 de 2012, los derechos que le asisten a los Titular de datos personales son: - Conocer, actualizar y rectificar sus datos personales frente a los Responsables del Tratamiento o Encargados del Tratamiento. Este derecho se podrá ejercer, entre otros frente a datos parciales, inexactos, incompletos, fraccionados, que induzcan a error, o aquellos cuyo Tratamiento esté expresamente prohibido o no haya sido autorizado.
- Solicitar prueba de la autorización otorgada al Responsable del Tratamiento salvo cuando expresamente se exceptúe como requisito para el Tratamiento.
- Ser informado por el Responsable del Tratamiento o el Encargado del Tratamiento, previa solicitud, respecto del uso que le ha dado a sus datos personales.
- Presentar ante la Superintendencia de Industria y Comercio quejas por infracciones a lo dispuesto en la Ley 1581 de 2012 y en las demás normas que la modifiquen, adicionen o complementen.
- Revocar la autorización y/o solicitar la supresión del dato cuando en el Tratamiento no se respeten los principios, derechos y garantías constitucionales y legales.
- Acceder en forma gratuita a los datos personales que hayan sido objeto de Tratamiento.
Los canales que existen en MUNILY para el ejercicio de los derechos de los Titular de los datos, se encuentran en el Capítulo XIII de la presente Política. CAPITULO XIII
PROCEDIMIENTO PARA EL EJERCICIO DE SUS DERECHOS COMO TITULAR DE DATOS
Los derechos de los Titulares establecidos en la Ley, podrán ser ejercidos ante MUNILY por las siguientes personas: - Por el Titular de los datos, quien deberá acreditar ante MUNILY su identidad en forma suficiente.
- Por los causahabientes del Titular de los datos, quienes deberán acreditar tal calidad ante MUNILY
- Por el representante y/o apoderado del Titular de los datos, previa acreditación ante MUNILY de la representación o apoderamiento
- Por estipulación a favor de otro o para otro.
De acuerdo con lo previsto en la legislación vigente aplicable, para el ejercicio de cualquiera de los derechos que asisten a los Titular de los datos, se podrá utilizar ante MUNILY cualquiera de los mecanismos que se establecen a continuación: Consultas:
- Los Titulares o sus causahabientes podrán consultar la información personal del Titular que repose en las bases de datos de MUNILY.
- MUNILY como responsable del Tratamiento suministrará a los Titulares o sus causahabientes, toda la información que se encuentre contenida en el registro individual o que esté vinculada con la identificación del Titular.
- La consulta se formulará a través de los canales que para dicho efecto han sido habilitados por MUNILY, los cuales se describen en el Numeral 3° del presente capítulo.
- La consulta será atendida por MUNILY en un término máximo de diez (10) días hábiles contados a partir de la fecha de recibo de la misma.
- Cuando no fuere posible para MUNILY atender la consulta dentro de dicho término, lo informará al interesado, expresando los motivos de la demora y señalando la fecha en que atenderá su consulta, la cual en ningún caso superará los cinco (5) días hábiles siguientes al vencimiento del primer término.
Reclamos:
- Los Titulares o los causahabientes que consideren que la información que se encuentra contenida en las bases de datos de MUNILY debe ser objeto de corrección, actualización o supresión, o cuando adviertan el presunto incumplimiento de cualquiera de los deberes contenidos en la ley, podrán presentar un reclamo ante MUNILY como responsable del Tratamiento, el cual será tramitado bajo las siguientes reglas:
- El reclamo se formulará mediante solicitud escrita dirigida a MUNILY, con la identificación del Titular, la descripción de los hechos que dan lugar al reclamo, la dirección, y acompañando los documentos que se quiera hacer valer.
- Al reclamo deberá adjuntarse fotocopia del documento de identificación del Titular de los datos
- El reclamo se formulará a través de los canales que para dicho efecto han sido habilitados por MUNILY, los cuales se describen en el Numeral 3° del presente capítulo.
- Si el reclamo resulta incompleto, MUNILY requerirá al interesado dentro de los cinco (5) días hábiles siguientes a la recepción del reclamo para que subsane las fallas.
- Transcurridos dos (2) meses desde la fecha del requerimiento realizado por MUNILY, sin que el solicitante presente la información requerida, la Compañía entenderá que se ha desistido del reclamo.
- En caso de que quien reciba el reclamo no sea competente para resolverlo, dará traslado a quien corresponda en un término máximo de dos (2) días hábiles e informará de la situación al interesado.
- Una vez MUNILY reciba el reclamo completo, incluirá en la base de datos una leyenda que indique: reclamo en trámite y el motivo del mismo, en un término no mayor a dos (2) días hábiles. Dicha leyenda deberá mantenerse hasta que el reclamo sea decidido.
- El término máximo para atender el reclamo por parte de MUNILY será de quince (15) días hábiles contados a partir del día siguiente a la fecha de su recibo.
- Cuando no fuere posible para MUNILY atender el reclamo dentro de dicho término, se informará al interesado los motivos de la demora y la fecha en que se atenderá su reclamo, la cual en ningún caso podrá superar los ocho (8) días hábiles siguientes al vencimiento del primer término.

Los derechos de los titulares podrán ser ejercidos por las personas antes señaladas a través de los canales que han sido habilitados por MUNILY para dicho efecto, los cuales se encuentran a su disposición de forma gratuita, así: - A través de la dirección de correo electrónico: soporte@munily.com.co

CAPITULO XIV
DEBERES DE MUNILY COMO RESPONSABLE DEL TRATAMIENTO
Como responsable del Tratamiento de datos personales, MUNILY debe cumplir con los siguientes deberes: - Garantizar al Titular, en todo tiempo, el pleno y efectivo ejercicio del derecho de hábeas data.
- Solicitar y conservar en las condiciones previstas en la ley, copia de la respectiva autorización otorgada por el Titular.
- Informar debidamente al Titular sobre la finalidad de la recolección y los derechos que le asisten por virtud de la autorización otorgada.
- Conservar la información bajo las condiciones de seguridad necesarias para impedir su adulteración, pérdida, consulta, uso o acceso no autorizado o fraudulento.
- Garantizar que la información que se suministre al Encargado del Tratamiento sea veraz, completa, exacta, actualizada, comprobable y comprensible.
- Actualizar la información, comunicando de forma oportuna al Encargado del Tratamiento, todas las novedades respecto de los datos que previamente le haya suministrado y adoptar las demás medidas necesarias para que la información suministrada a éste se mantenga actualizada.
- Rectificar la información cuando sea incorrecta y comunicar lo pertinente al Encargado del Tratamiento.
- Suministrar al Encargado del Tratamiento, según el caso, únicamente datos cuyo Tratamiento esté previamente autorizado de conformidad con lo previsto en la ley.
- Exigir al Encargado del Tratamiento en todo momento, el respeto a las condiciones de seguridad y privacidad de la información del Titular.
- Tramitar las consultas y reclamos formulados en los términos señalados en la ley.
- Adoptar un manual interno de políticas y procedimientos para garantizar el adecuado cumplimiento de la ley y en especial, para la atención de consultas y reclamos.
- Informar al Encargado del Tratamiento cuando determinada información se encuentra en discusión por parte del Titular, una vez se haya presentado la reclamación y no haya finalizado el trámite respectivo.
- Informar a solicitud del Titular sobre el uso dado a sus datos.
- Informar a la autoridad de protección de datos cuando se presenten violaciones a los códigos de seguridad y existan riesgos en la administración de la información de los Titulares.
- Cumplir las instrucciones y requerimientos que imparta la Superintendencia de Industria y Comercio.
CAPITULO XV
POLÍTICA DE COOKIES
MUNILY en Colombia maneja la política de cookies de MUNILY y por ello en el aviso de la página web de Colombia se deberá redireccionar a las estipulaciones que sobre las cookies tenga MUNILY Global. MUNILY en Colombia deberá propender porque los usuarios de su app y página web puedan acceder a la política de cookies de MUNILY. Los usuarios de la página web y de la app tendrán la facultad de cambiar o modificar el consentimiento de la declaración de cookies. Definición de cookies

En todo caso, lo invitamos a revisar regular o periódicamente nuestra página web www.munily.com., a través de la cual se le informará sobre el cambio y se pondrá a su disposición la última versión de esta Política o los mecanismos habilitados por MUNILY para obtener una copia de esta. POLÍTICA PRIVACIDAD DE DATOS MUNILY
MUNILY en Colombia hace parte de MUNILY INC y por lo tanto en todo aquello que sea aplicable y no contraríe la legislación colombiana sobre la materia, el grupo MUNILY, sus clientes, proveedores, contratistas, empleados activos o inactivos, se acogerá a los lineamientos y políticas establecidas para el tratamiento de datos personales de MUNILY INC, especialmente en todo lo relacionado con la transmisión, intercambio y/o seguridad de la información de datos entre los países miembros. CAPITULO I

OBJETIVO DE LA POLÍTICA DE TRATAMIENTO
Con el objetivo de dar cumplimiento a la legislación vigente en materia de protección de datos, en especial la Ley 1581 de 2012 y al Decreto 1377 de 2013 (y demás normas que los modifiquen, adicionen, complementen o desarrollen), a continuación señalamos los aspectos relevantes en relación con la recolección, uso y transferencia de datos personales que MUNILY S.A.S. en Colombia (en adelante MUNILY), realiza de los datos personales, en virtud de la autorización que haya sido otorgada para dicho tratamiento.. En esta política de tratamiento de datos personales (la “Política”) se encuentran los lineamientos corporativos y de ley, bajo los cuales MUNILY realiza el tratamiento de los datos personales, la finalidad, los derechos de los titulares, así como los procedimientos internos y externos que existen para el ejercicio de tales derechos ante la Compañía, entre otros: Conforme a lo previsto en el artículo 15 de la Constitución Política de Colombia y la legislación aplicable (Ley 1266 de 2008, Ley 1581 de 2012, Decreto 1377 de 2013 y todas aquellas normas que las reglamenten, adicionen, deroguen o modifiquen), en MUNILY tenemos una clara política de privacidad y protección de datos personales que incluye a profesionales independientes, clientes, proveedores, empleados que tengan una relación comercial o jurídica con el Grupo MUNILY y que hayan suministrado voluntariamente su consentimiento previo, expreso e informadoCAPITULO III
ANTECEDENTES DE LA POLÍTICA DE TRATAMIENTO
Los sucesos que anteceden la elaboración y divulgación de la presente Política de Tratamiento de Datos Personales son aquellos que se exponen a continuación:- Mediante la Ley 1581 de Octubre 17 de 2012 se expidió el Régimen General de Protección de Datos Personales, el cual, de conformidad con su artículo 1°, tiene por objeto: (…) desarrollar el derecho constitucional que tienen todas las personas a conocer, actualizar y rectificar las informaciones que se hayan recogido sobre ellas en bases de datos o archivos, y los demás derechos, libertades y garantías constitucionales a que se refiere el artículo 15 de la Constitución Política; así como el derecho a la información consagrado en el artículo 20 de la misma”.
- La Ley 1581 de 2012 constituye el marco general de la protección de los datos personales en Colombia.
- Mediante Sentencia C-748 del 6 de octubre de 2011 la Corte Constitucional declaró exequible el Proyecto de Ley Estatutaria No. 184 de 2010 – Senado, 046 de 2010 -Cámara.
- Mediante Decreto 1377 de Junio 27 de 2013, el Ministerio de Comercio, Industria y Turismo reglamentó aspectos relacionados con la autorización del Titular de información para el Tratamiento de sus datos personales, las políticas de Tratamiento de los Responsables y Encargados, el ejercicio de los derechos de los Titulares de información, las transferencias de datos personales y la responsabilidad demostrada frente al Tratamiento de datos personales, este último tema referido a la rendición de cuentas.
- Mediante Decreto 1074 de 2015, capitulo 25 se reglamenta parcialmente la Ley 1581 de 2012 y el capítulo 26 el Registro Nacional de Bases de Datos.
- Circular 002 del 3 de noviembre de 2015 emitida por la Superintendencia de Industria y Comercio, con la cual se habilita el Registro Nacional de Bases de Datos.
CAPITULO IV
A QUIÉN SE DIRIGE LA POLÍTICA DE TRATAMIENTO
La presente Política de Tratamiento de Datos Personales está dirigida a Clientes y potenciales clientes, Proveedores, Empleados de MUNILY, tanto activos como inactivos, administradores, guardas de seguridad, residentes e invitados de copropiedades cuyos datos personales se encuentran incluidos en las Bases de Datos de la Compañía.CAPITULO V
DEFINICIONES RELEVANTES DE LA POLÍTICA DE TRATAMIENTO
Para la interpretación de esta Política, se deben tener en cuenta las siguientes definiciones:- Aviso de Privacidad: Comunicación verbal o escrita generada por el Responsable, dirigida al Titular para el Tratamiento de sus datos personales, mediante la cual se le informa acerca de la existencia de las políticas de Tratamiento de información que le serán aplicables, la forma de acceder a las mismas y las finalidades del Tratamiento que se pretende dar a los datos personales.
- Titular: Toda persona que, como destinatario final, ya sea de los servicios de MUNILY o ejerciendo como profesionales independientes, trabajadores, Clientes, y potenciales clientes, Proveedores, Empleados de MUNILY, administradores, guardas de seguridad, residentes e invitados de copropiedades, tanto activos como inactivos y demás personas en general.
- Dato Personal: Cualquier información vinculada o que pueda asociarse a una o varias personas naturales determinadas o determinables.
- Datos Sensibles: Aquellos datos que afectan la intimidad del Titular o cuyo uso indebido puede generar su discriminación.
- Empleado: Persona natural que en virtud de un contrato de trabajo se obliga a prestar un servicio personal a otra persona natural o jurídica, bajo la continuada dependencia o subordinación de la segunda y mediante remuneración.
- Encargado del Tratamiento: Persona natural o jurídica, pública o privada, que por sí misma o en asocio con otros, realice el Tratamiento de datos personales por cuenta de MUNILY como Responsable de los datos.
- Política de Tratamiento: Se refiere al presente documento, como política de tratamiento de datos personales aplicada por MUNILY de conformidad con los lineamientos de la legislación vigente en la materia.
- Proveedor: Toda persona natural o jurídica que preste algún servicio a MUNILY en virtud de una relación contractual / obligacional.
- Responsable del Tratamiento: Persona natural o jurídica, pública o privada, que por sí misma o en asocio con otros, decida sobre la base de datos y/o el Tratamiento de los Datos, para efectos de esta política, ejercerá como Responsable, en principio, MUNILY.
- Transferencia: Se refiere al envío por parte de MUNILY como responsable del Tratamiento o un Encargado de los datos, a un tercer agente o persona natural /jurídica (receptor), dentro o fuera del territorio nacional para el tratamiento efectivo de datos personales.
- Trasmisión: Se refiere a la comunicación de datos personales por parte del Responsable al Encargado, ubicado dentro o fuera del territorio nacional, para que el Encargado, por cuenta del Responsable, trate datos personales.
- Tratamiento: Cualquier operación o conjunto de operaciones sobre datos personales, tales como la recolección, almacenamiento, uso, circulación o supresión.
CAPITULO VI
PRINCIPIOS PARA EL TRATAMIENTO DE DATOS PERSONALES
Los principios que rigen el Tratamiento de Datos Personales por parte de MUNILY, son los siguientes:- Principio de Legalidad en materia de tratamiento de datos: El Tratamiento a que se refiere la Ley 1581 de 2012 es una actividad reglada que debe sujetarse a lo establecido en ella y en las demás disposiciones que la desarrollen.
- Principio de Finalidad El Tratamiento de los datos personales debe obedecer a una finalidad legítima de acuerdo con la Constitución y la Ley, la cual debe ser informada al Titular.
- Principio de Libertad: El Tratamiento de los datos personales sólo puede ejercerse con el consentimiento, previo, expreso e informado del Titular. Los datos personales no podrán ser obtenidos o divulgados sin previa autorización, o en ausencia de mandato legal o judicial que releve el consentimiento.
- Principio de Veracidad o Calidad La información sujeta a Tratamiento debe ser veraz, completa, exacta, actualizada, comprobable y comprensible. Se prohíbe el Tratamiento de datos parciales, incompletos, fraccionados o que induzcan a error.
- Principio de Transparencia: En el Tratamiento debe garantizarse el derecho del Titular a obtener del Responsable del Tratamiento o del Encargado del Tratamiento, en cualquier momento y sin restricciones, información acerca de la existencia de datos que le conciernan.
- Principio de Acceso y Circulación Restringida: El Tratamiento se sujeta a los límites que se derivan de la naturaleza de los datos personales, de las disposiciones de la ley y la Constitución. En este sentido, el Tratamiento sólo podrá hacerse por personas autorizadas por el Titular y/o por las personas previstas en la ley.
- Principio de Seguridad: La información sujeta a Tratamiento por el Responsable del Tratamiento o Encargado del Tratamiento, se deberá manejar con las medidas técnicas, humanas y administrativas que sean necesarias para otorgar seguridad a los registros evitando su adulteración, pérdida, consulta, uso o acceso no autorizado o fraudulento.
- Principio de Confidencialidad: Todas las personas que intervengan en el Tratamiento de datos personales que no tengan la naturaleza de públicos están obligadas a garantizar la reserva de la información, inclusive después de finalizada su relación con alguna de las labores que comprende el Tratamiento, pudiendo sólo realizar suministro o comunicación de datos personales cuando ello corresponda al desarrollo de las actividades autorizadas en la ley y en los términos de la misma.
CAPITULO VII
AUTORIZACIÓN DEL TITULAR PARA EL TRATAMIENTO DE DATOS
MUNILY como Responsable del Tratamiento ha adoptado procedimientos para solicitar, a más tardar en el momento de la recolección de los datos personales, la correspondiente autorización para el Tratamiento de los mismos e informar cuáles son los datos personales que serán recolectados, así como todas las finalidades específicas del Tratamiento para las cuales se obtiene el consentimiento. Sin embargo, tratándose de datos personales que se encuentren en fuentes de acceso público, con independencia del medio por el cual se tenga acceso, entendiéndose por tales aquellos datos o bases de datos que se encuentren a disposición del público, se tiene que éstos pueden ser tratados por MUNILY, siempre y cuando, por su naturaleza, sean datos públicos. MUNILY como Responsable del Tratamiento de datos personales ha establecido mecanismos para obtener la autorización de los Titulares o de quien se encuentre legitimado para tal efecto. Se entenderá que la autorización otorgada por el Titular a MUNILY, cumple con los requisitos exigidos en la legislación vigente aplicable, cuando ésta se manifieste: (i) por escrito; (ii) de forma oral; o (iii) mediante conductas inequívocas del Titular que permitan concluir de forma razonable que éste otorgó a MUNILY la autorización respectiva. En ningún caso el silencio de los titulares del dato para emitir su consentimiento o autorización será asimilado por MUNILY como una conducta inequívoca. Los Titular de datos personales pueden en todo momento solicitar a MUNILY como Responsable del Tratamiento, la supresión de sus datos personales y/o revocar la autorización que le fue otorgada a MUNILY para el Tratamiento de los datos, para lo cual se han habilitado los canales previstos en el Numeral 3° del Capítulo Décimo Segundo de la presente Política.CAPITULO VIII
AUTORIZACIÓN DEL TITULAR PARA EL TRATAMIENTO DE DATOS SENSIBLES
De acuerdo con lo previsto en el Capítulo V de la presente Política, se entiende por Datos Sensibles: “aquellos datos que afectan la intimidad del Titular o cuyo uso indebido puede generar su discriminación”. El tratamiento de los datos sensibles a los cuales se refiere el Artículo 5° de la Ley 1581 de 2012 está prohibido, a excepción de los casos que a continuación se relacionan:- Cuando el Titular haya dado su autorización explícita a dicho Tratamiento, salvo en los casos que por ley no sea requerido el otorgamiento de dicha autorización.
- Cuando el Tratamiento sea necesario para salvaguardar el interés vital del Titular y este se encuentre física o jurídicamente incapacitado. En estos eventos, los representantes legales deberán otorgar su autorización.
- Cuando el Tratamiento sea efectuado en el curso de las actividades legítimas y con las debidas garantías por parte de una fundación, ONG, asociación o cualquier otro organismo sin ánimo de lucro, cuya finalidad sea política, filosófica, religiosa o sindical, siempre que se refieran exclusivamente a sus miembros o a las personas que mantengan contactos regulares por razón de su finalidad. En estos eventos, los datos no se podrán suministrar a terceros sin la autorización del Titular.
- Cuando el Tratamiento se refiera a datos que sean necesarios para el reconocimiento, ejercicio o defensa de un derecho en un proceso judicial;
- Cuando el Tratamiento tenga una finalidad histórica, estadística o científica. En este evento deberán adoptarse las medidas conducentes a la supresión de identidad de los Titulares.
- Informa al Titular que por tratarse de datos sensibles no está obligado a autorizar su Tratamiento.
- Informa al Titular de forma explícita y previa, además de los requisitos generales de la autorización para la recolección de cualquier tipo de dato personal, cuáles de los datos que serán objeto de Tratamiento son sensibles y la finalidad de su Tratamiento, y además obtiene su consentimiento expreso.
CAPITULO IX
USO Y FINALIDAD DEL TRATAMIENTO
MUNILY reconoce que los Titular de datos personales tiene derecho a contar con una expectativa razonable de su privacidad, teniendo en todo caso para ello en cuenta sus responsabilidades, derechos y obligaciones con la Compañía. MUNILY utilizará los datos personales recolectados con las siguientes finalidades:- Ejecutar los contratos que se tienen suscritos con los clientes.
- Para brindar soluciones de seguridad y comunicación comunitaria en propiedades horizontales.
- Realizar el pago de las obligaciones contractuales.
- Enviar la información a entidades gubernamentales o judiciales por solicitud expresa de las mismas.
- Soportar procesos de auditoría externa e interna.
- Realizar el pago de nómina, expedición de certificaciones laborales, invitaciones a eventos de la compañía a sus trabajadores activos.
- Expedición de certificados laborales solicitados por trabajadores que se hayan retirado de la empresa.
- Desarrollar campañas de comunicación internas que puedan contender datos de los empleados de MUNILY en Colombia.
- Contactar a profesionales independientes, trabajadores, cliente y proveedores, para el envió de información comercial que pueda ser solicitada o que tenga que ver con la relación contractual entre las partes.
- Contactar profesionales que envíen sus hojas de vida para realizar entrevistas de trabajo.
- Presentación de propuestas que sean solicitadas ya sea electrónicamente, por escrito o por medios electrónicos.
- Envío de correos electrónicos contentivos de boletines, publicaciones, invitaciones a eventos e información que pueda ser relevante para los clientes y/o prospectos
- Envío de propuestas y portafolio de servicios.
- Envío de encuestas de satisfacción y programas de mejora del servicio (solo para clientes).
CAPITULO X
TRATAMIENTO DE DATOS PERSONALES
La presente Política de Seguridad se extiende y da alcance a las diversas áreas que hacen parte del tratamiento (uso, recolección, circulación, almacenamiento y supresión) de datos personales; lo anterior con el fin de homogenizar procedimientos en la gestión y administración de riesgos en el tratamiento de datos personales. Esta Política de Seguridad se aplica a todas las Bases de Datos de MUNILY que contienen datos personales, ya sean estas digitales o físicas y vincula a cada una de las áreas y personal designado para el tratamiento de datos personales. La política se hará extensiva en lo aplicable a los encargados del tratamiento con quienes MUNILY establezca vínculos en lo que resulte aplicable Este documento aplica a todos los trabajadores, contratistas y personal vinculado a MUNILY en virtud de cualquier tipo de relación contractual y que intervenga en el tratamiento de datos personales en virtud de desarrollo del contrato Para el efecto se entenderá como dato personal cualquier información vinculada o que pueda asociarse a personas naturales. Para considerarlo como dato personal debe responder afirmativamente a la siguiente pregunta ¿Con el dato puedo identificar directa o directamente a una persona natural? De acuerdo al Decreto 1377 de 2013, MUNILY, sólo podrá recolectar, almacenar, usar o circular los datos personales de una persona, durante el tiempo que sea razonable y necesario, de acuerdo con las finalidades que justificaron el tratamiento, atendiendo a las disposiciones aplicables a la materia de que se trate y a los aspectos administrativos, contables, fiscales, jurídicos e históricos de la información. Una vez cumplida la o las finalidades del Tratamiento y sin perjuicio de normas legales que dispongan lo contrario MUNILY deberá proceder a la supresión de los datos personales que tenga en su posesión. Como excepción a lo anterior, MUNILY podrá conservar los datos personales cuando así se requiera para el cumplimiento de una obligación legal o contractual. En los casos en que MUNILY trate datos sensibles, definido como todo dato que afecta la intimidad del titular o cuyo uso indebido puede generar su discriminación, éstos serán protegidos conforme al marco y limitaciones establecidas por la Ley. MUNILY propenderá por darle cumplimiento a las medidas de seguridad digitales y físicas aquí establecidas, las cuales son adecuadas para velar por la seguridad de los datos sensibles. Así entonces, todo tratamiento (uso, recolección, circulación, almacenamiento y archivo) del dato personal, debe contar con autorización por parte del titular según las finalidades señaladas por el responsable. Por tanto, es deber de MUNILY velar porque las áreas que intervengan en todo el ciclo de vida del dato cumplan con lo dispuesto en la política de tratamiento y se dé el efectivo uso al dato personal según las finalidades autorizadas por el titular.TRATAMIENTO DE DATOS PERSONALES DE MENORES.
El tratamiento de datos de menores se debe sujetar a los principios, parámetros y requisitos contenidos en el Artículo 7º de la Ley 1581 de 2012, el Artículo 12 del Decreto 1377 de 2013 y la Sentencia C-778 de 2012 de la Corte Constitucional.
- El tratamiento de los datos personales de los menores de 18 años, pueden ser objeto de tratamiento siempre y cuando el fin que se persiga responda al interés superior de los niños, las niñas y adolescentes y se asegure sin excepción alguna el respeto de sus derechos prevalentes. De conformidad con lo anterior, será posible de manera excepcional el tratamiento de datos personales de los niños, niñas y adolescentes cuando se cumplan los siguientes criterios:
- La finalidad del tratamiento responda al interés superior de los niños, niñas y adolescentes.
- Se asegure el respeto de los derechos fundamentales de los niños, niñas y adolescentes
- De acuerdo con la madurez del niño, niña o adolescente se tenga en cuenta su opinión.
- Se cumpla con los requisitos previstos en la Ley 1581 de 2012 para el tratamiento de datos personales.
- Se obtenga autorización previa otorgada por el representante legal del menor, quienes generalmente son los padres.
VIDEOVIGILANCIA
Mediante la app Munily se podrán captar la imagen de las personas y vehículos que ingresan a las copropiedades que utilizan la app Munily, quienes previamente al ingreso son informadas de dicha situación por las personas encargadas de la recepción, quienes adicionalmente buscarán en ese momento la autorización del titular. La finalidad de estos sistemas tiene como único propósito la seguridad tanto de las personas que ingresan a la propiedad horizontal como de sus residentes
POLÍTICAS DEL ENCARGADO DE TRATAMIENTO DE DATOS PERSONALES
Se le llama ENCARGADO a aquel que realiza el tratamiento de los datos personales por cuenta de MUNILY, es decir, a quien MUNILY le está encomendando el manejo de un compendio de datos personales, ya sean entregados directamente por los titulares del dato o por terceros a MUNILY. En este sentido los datos personales entregados por parte de MUNILY deberán ser usados únicamente para el encargo encomendado y de conformidad con los lineamientos establecidos
Según la normatividad colombiana aplicable a la protección de datos personales y la jurisprudencia relacionada con el tema, el responsable del tratamiento del dato personal, es decir MUNILY y EL ENCARGADO del tratamiento, responden concurrente y solidariamente frente al titular del dato personal. Lo anterior frente a la veracidad, integridad, finalidad e incorporación del dato personal, así como en el tratamiento (uso, recolección, almacenamiento, circulación y supresión) del mismo; en el entendido que cualquier uso debe hacerse con autorización del titular.
En virtud de lo anterior, EL ENCARGADO se compromete con MUNILY a verificar el estado de entrega de los datos personales, así como ofrecer las medidas de seguridad necesarias para velar por la seguridad del dato según las medidas de la presente Política de Seguridad. Es deber del ENCARGADO prestar la mayor diligencia en la ejecución de su labor respecto de la protección y seguridad del dato personal, tanto en bases de datos digitales como físicas.
EL ENCARGADO responde por el uso, custodia y protección de los datos personales entregados por MUNILY, razón por la cual responderá hasta por culpa levísima respecto de la protección y custodia de los datos personales otorgados. Cualquier conducta contraria a las políticas aquí establecidas o su omisión, comprometerá la responsabilidad del ENCARGADO.
EL ENCARGADO deberá cumplir con los deberes consagrados en la Política del Encargado y con los demás deberes que establece el artículo 18 de la Ley 1581 de 2012 y así mismo, deberá responderá hasta por sus empleados o contratistas.
CAPITULO XI
REVOCATORIA DE LA AUTORIZACIÓN Y/O SUPRESIÓN DEL DATO
Los Titulares de datos pueden en todo momento solicitar a MUNILY como Responsable del Tratamiento, la supresión de sus datos personales y/o revocar la autorización que le ha otorgado para el Tratamiento de los mismos, mediante la presentación de un reclamo, de acuerdo con lo establecido en el artículo 15 de la Ley 1581 de 2012. Sin embargo, es importante tener en cuenta que la solicitud de supresión de la información y la revocatoria de la autorización no procederá cuando como Titular de los datos tenga un deber legal o contractual en virtud del cual deba permanecer en la base de datos de MUNILY. MUNILY ha dispuesto mecanismos de fácil acceso y gratuitos, para que los Titulares de los datos presenten en cualquier momento solicitudes de supresión de sus datos o revocatoria de la autorización otorgada. Dichos mecanismos se encuentran enunciados en el numeral 3° del Capítulo XIII del presente documento. Si vencido el término legal respectivo, MUNILY como Responsable no elimina los datos personales de sus bases de datos, el Titular podrá solicitar a la Superintendencia de Industria y Comercio que ordene la revocatoria de la autorización y/o la supresión de los datos personales. Para estos efectos se aplicará el procedimiento descrito en el artículo 22 de la Ley 1581 de 2012. Finalmente, es importante resaltar que, los datos personales serán conservados en las bases de datos de MUNILY cuando así se requiera en cumplimiento de una obligación legal o contractual.CAPITULO XII
DERECHOS DE LOS TITULARES DE LOS DATOS
De conformidad con lo establecido en el Artículo 8 de la Ley 1581 de 2012, los derechos que le asisten a los Titular de datos personales son:- Conocer, actualizar y rectificar sus datos personales frente a los Responsables del Tratamiento o Encargados del Tratamiento. Este derecho se podrá ejercer, entre otros frente a datos parciales, inexactos, incompletos, fraccionados, que induzcan a error, o aquellos cuyo Tratamiento esté expresamente prohibido o no haya sido autorizado.
- Solicitar prueba de la autorización otorgada al Responsable del Tratamiento salvo cuando expresamente se exceptúe como requisito para el Tratamiento.
- Ser informado por el Responsable del Tratamiento o el Encargado del Tratamiento, previa solicitud, respecto del uso que le ha dado a sus datos personales.
- Presentar ante la Superintendencia de Industria y Comercio quejas por infracciones a lo dispuesto en la Ley 1581 de 2012 y en las demás normas que la modifiquen, adicionen o complementen.
- Revocar la autorización y/o solicitar la supresión del dato cuando en el Tratamiento no se respeten los principios, derechos y garantías constitucionales y legales.
- Acceder en forma gratuita a los datos personales que hayan sido objeto de Tratamiento.
CAPITULO XIII
PROCEDIMIENTO PARA EL EJERCICIO DE SUS DERECHOS COMO TITULAR DE DATOS
Los derechos de los Titulares establecidos en la Ley, podrán ser ejercidos ante MUNILY por las siguientes personas:- Por el Titular de los datos, quien deberá acreditar ante MUNILY su identidad en forma suficiente.
- Por los causahabientes del Titular de los datos, quienes deberán acreditar tal calidad ante MUNILY
- Por el representante y/o apoderado del Titular de los datos, previa acreditación ante MUNILY de la representación o apoderamiento
- Por estipulación a favor de otro o para otro.
Consultas:
- Los Titulares o sus causahabientes podrán consultar la información personal del Titular que repose en las bases de datos de MUNILY.
- MUNILY como responsable del Tratamiento suministrará a los Titulares o sus causahabientes, toda la información que se encuentre contenida en el registro individual o que esté vinculada con la identificación del Titular.
- La consulta se formulará a través de los canales que para dicho efecto han sido habilitados por MUNILY, los cuales se describen en el Numeral 3° del presente capítulo.
- La consulta será atendida por MUNILY en un término máximo de diez (10) días hábiles contados a partir de la fecha de recibo de la misma.
- Cuando no fuere posible para MUNILY atender la consulta dentro de dicho término, lo informará al interesado, expresando los motivos de la demora y señalando la fecha en que atenderá su consulta, la cual en ningún caso superará los cinco (5) días hábiles siguientes al vencimiento del primer término.
Reclamos:
- Los Titulares o los causahabientes que consideren que la información que se encuentra contenida en las bases de datos de MUNILY debe ser objeto de corrección, actualización o supresión, o cuando adviertan el presunto incumplimiento de cualquiera de los deberes contenidos en la ley, podrán presentar un reclamo ante MUNILY como responsable del Tratamiento, el cual será tramitado bajo las siguientes reglas:
- El reclamo se formulará mediante solicitud escrita dirigida a MUNILY, con la identificación del Titular, la descripción de los hechos que dan lugar al reclamo, la dirección, y acompañando los documentos que se quiera hacer valer.
- Al reclamo deberá adjuntarse fotocopia del documento de identificación del Titular de los datos
- El reclamo se formulará a través de los canales que para dicho efecto han sido habilitados por MUNILY, los cuales se describen en el Numeral 3° del presente capítulo.
- Si el reclamo resulta incompleto, MUNILY requerirá al interesado dentro de los cinco (5) días hábiles siguientes a la recepción del reclamo para que subsane las fallas.
- Transcurridos dos (2) meses desde la fecha del requerimiento realizado por MUNILY, sin que el solicitante presente la información requerida, la Compañía entenderá que se ha desistido del reclamo.
- En caso de que quien reciba el reclamo no sea competente para resolverlo, dará traslado a quien corresponda en un término máximo de dos (2) días hábiles e informará de la situación al interesado.
- Una vez MUNILY reciba el reclamo completo, incluirá en la base de datos una leyenda que indique: reclamo en trámite y el motivo del mismo, en un término no mayor a dos (2) días hábiles. Dicha leyenda deberá mantenerse hasta que el reclamo sea decidido.
- El término máximo para atender el reclamo por parte de MUNILY será de quince (15) días hábiles contados a partir del día siguiente a la fecha de su recibo.
- Cuando no fuere posible para MUNILY atender el reclamo dentro de dicho término, se informará al interesado los motivos de la demora y la fecha en que se atenderá su reclamo, la cual en ningún caso podrá superar los ocho (8) días hábiles siguientes al vencimiento del primer término.

CAPITULO XIV
DEBERES DE MUNILY COMO RESPONSABLE DEL TRATAMIENTO
Como responsable del Tratamiento de datos personales, MUNILY debe cumplir con los siguientes deberes:- Garantizar al Titular, en todo tiempo, el pleno y efectivo ejercicio del derecho de hábeas data.
- Solicitar y conservar en las condiciones previstas en la ley, copia de la respectiva autorización otorgada por el Titular.
- Informar debidamente al Titular sobre la finalidad de la recolección y los derechos que le asisten por virtud de la autorización otorgada.
- Conservar la información bajo las condiciones de seguridad necesarias para impedir su adulteración, pérdida, consulta, uso o acceso no autorizado o fraudulento.
- Garantizar que la información que se suministre al Encargado del Tratamiento sea veraz, completa, exacta, actualizada, comprobable y comprensible.
- Actualizar la información, comunicando de forma oportuna al Encargado del Tratamiento, todas las novedades respecto de los datos que previamente le haya suministrado y adoptar las demás medidas necesarias para que la información suministrada a éste se mantenga actualizada.
- Rectificar la información cuando sea incorrecta y comunicar lo pertinente al Encargado del Tratamiento.
- Suministrar al Encargado del Tratamiento, según el caso, únicamente datos cuyo Tratamiento esté previamente autorizado de conformidad con lo previsto en la ley.
- Exigir al Encargado del Tratamiento en todo momento, el respeto a las condiciones de seguridad y privacidad de la información del Titular.
- Tramitar las consultas y reclamos formulados en los términos señalados en la ley.
- Adoptar un manual interno de políticas y procedimientos para garantizar el adecuado cumplimiento de la ley y en especial, para la atención de consultas y reclamos.
- Informar al Encargado del Tratamiento cuando determinada información se encuentra en discusión por parte del Titular, una vez se haya presentado la reclamación y no haya finalizado el trámite respectivo.
- Informar a solicitud del Titular sobre el uso dado a sus datos.
- Informar a la autoridad de protección de datos cuando se presenten violaciones a los códigos de seguridad y existan riesgos en la administración de la información de los Titulares.
- Cumplir las instrucciones y requerimientos que imparta la Superintendencia de Industria y Comercio.
CAPITULO XV
POLÍTICA DE COOKIES
MUNILY en Colombia maneja la política de cookies de MUNILY y por ello en el aviso de la página web de Colombia se deberá redireccionar a las estipulaciones que sobre las cookies tenga MUNILY Global. MUNILY en Colombia deberá propender porque los usuarios de su app y página web puedan acceder a la política de cookies de MUNILY. Los usuarios de la página web y de la app tendrán la facultad de cambiar o modificar el consentimiento de la declaración de cookies.Definición de cookies

OBJECTIVE OF THE TREATMENT POLICY
In order to comply with current legislation on data protection, especially Law 1581 of 2012 and Decree 1377 of 2013 (and other rules that modify, add, supplement or develop them), below we indicate the relevant aspects in relation to the collection, use and transfer of personal data that MUNILY S.A.S. in Colombia (hereinafter MUNILY), makes of personal data, under the authorization that has been granted for such treatment. TREATMENT POLICY BACKGROUND
The events that preceded the preparation and disclosure of this Personal Data Processing Policy are those set forth below: - Law 1581 of October 17, 2012 issued the General Regime for the Protection of Personal Data, which, according to its Article 1°, aims to: (...) develop the constitutional right that all persons have to know, update and rectify the information that has been collected about them in databases or files, and the other rights, freedoms and constitutional guarantees referred to in Article 15 of the Political Constitution; as well as the right to information enshrined in Article 20 of the same".
- Law 1581 of 2012 constitutes the general framework for the protection of personal data in Colombia.
- By Ruling C-748 of October 6, 2011, the Constitutional Court declared constitutional the Statutory Bill No. 184 of 2010 - Senate, 046 of 2010 - House of Representatives.
- By Decree 1377 of June 27, 2013, the Ministry of Commerce, Industry and Tourism regulated aspects related to the authorization of the Data Controller for the Processing of personal data, the Processing policies of the Controllers and Processors, the exercise of the rights of the Data Controllers, the transfers of personal data and the responsibility demonstrated in relation to the Processing of personal data, this last topic referring to accountability.
- By Decree 1074 of 2015, chapter 25 partially regulates Law 1581 of 2012 and chapter 26 the National Database Registry.

This Personal Data Processing Policy is addressed to Clients and potential clients, Suppliers, MUNILY's Employees, both active and inactive, administrators, security guards, residents and guests of co-ownerships whose personal data is included in the Company's Databases. CHAPTER V
RELEVANT DEFINITIONS OF THE TREATMENT POLICY
For the interpretation of this Policy, the following definitions should be taken into account: - Privacy Notice: Verbal or written communication generated by the Controller, addressed to the Data Subject for the Processing of his personal data, by means of which he is informed about the existence of the information processing policies that will be applicable, the way to access them and the purposes of the Processing that is intended to be given to the personal data.
- Holder: Any person who, as final recipient, either of MUNILY's services or exercising as independent professionals, workers, Clients, and potential clients, Suppliers, MUNILY's Employees, administrators, security guards, residents and guests of co-ownerships, both active and inactive, and other persons in general.
- Personal Data: Any information linked or that can be associated to one or several determined or determinable natural persons.
- Sensitive Data: Data that affect the privacy of the Data Subject or whose improper use may generate discrimination.
- Employee: A natural person who, by virtue of an employment contract, undertakes to render a personal service to another natural or legal person, under the continued dependence or subordination of the latter and for remuneration.
- Data Processor: Natural or legal person, public or private, that by itself or in association with others, carries out the Processing of personal data on behalf of MUNILY as Data Controller.
- Processing Policy: Refers to this document, as the personal data processing policy applied by MUNILY in accordance with the guidelines of the current legislation on the matter.
- Supplier: Any natural or legal person that provides any service to MUNILY by virtue of a contractual/obligatory relationship.
- Data Controller: Natural or legal person, public or private, that by itself or in association with others, decides on the database and/or the Processing of the Data, for the purposes of this policy, MUNILY shall act as Data Controller, in principle, MUNILY.
- Transfer: Refers to the sending by MUNILY as a Data Controller or a Data Processor, to a third party agent or natural/legal person (recipient), within or outside the national territory for the effective processing of personal data.
- Transmission: Refers to the communication of personal data by the Controller to the Processor, located within or outside the national territory, so that the Processor, on behalf of the Controller, processes personal data.
- Processing: Any operation or set of operations on personal data, such as collection, storage, use, circulation or deletion.
For the understanding of the terms that are not included in the above list, reference should be made to the legislation in force, especially Law 1581 of 2012 and Decree 1377 of 2013 and those that complement, add and/or modify the legislation in force in this regard. Additionally, in case of doubt about any of the definitions provided herein, it shall be given the meaning that has been used by the legislator in the aforementioned rules. CHAPTER VI
PRINCIPLES FOR THE PROCESSING OF PERSONAL DATA
The principles governing the Processing of Personal Data by MUNILY are the following: - Principle of Legality in data processing: The Processing referred to in Law 1581 of 2012 is a regulated activity that must be subject to what is established therein and in the other provisions that develop it.
- Principle of Purpose The processing of personal data must obey a legitimate purpose in accordance with the Constitution and the Law, which must be informed to the Data Subject.
- Principle of Freedom: The processing of personal data can only be exercised with the prior, express and informed consent of the Data Subject. Personal data may not be obtained or disclosed without prior authorization, or in the absence of legal or judicial mandate that relieves the consent.
- Principle of Truthfulness or Quality The information subject to Processing must be truthful, complete, accurate, updated, verifiable and understandable. The processing of partial, incomplete, fractioned or misleading data is prohibited.
- Principle of Transparency: The right of the Data Subject to obtain from the Data Controller or the Data Processor, at any time and without restrictions, information about the existence of data concerning him/her, must be guaranteed.
- Principle of Access and Restricted Circulation: Processing is subject to the limits derived from the nature of the personal data, the provisions of the law and the Constitution. In this sense, the Processing may only be carried out by persons authorized by the Holder and/or by the persons provided by law.
Personal data, except for public information, may not be made available on the Internet or other means of mass dissemination or communication, unless access is technically controllable to provide restricted knowledge only to Data Holders or authorized third parties in accordance with the law. - Security Principle: The information subject to Processing by the Data Controller or Data Processor shall be handled with the technical, human and administrative measures necessary to provide security to the records avoiding their adulteration, loss, consultation, unauthorized or fraudulent use or access.
- Confidentiality Principle: All persons involved in the processing of personal data that are not of a public nature are obliged to guarantee the confidentiality of the information, even after the end of their relationship with any of the tasks involved in the processing, and may only provide or communicate personal data when it corresponds to the development of the activities authorized by law and under the terms of the same.
CHAPTER VII
HOLDER'S AUTHORIZATION FOR DATA PROCESSING
MUNILY as Data Controller has adopted procedures to request, at the latest at the time of collection of personal data, the corresponding authorization for the Processing of personal data and to inform which personal data will be collected, as well as all the specific purposes of the Processing for which consent is obtained. However, in the case of personal data that are in publicly accessible sources, regardless of the means by which they are accessed, meaning those data or databases that are available to the public, they may be processed by MUNILY, provided that, by their nature, they are public data. MUNILY as Responsible for the Processing of personal data has established mechanisms to obtain the authorization of the Owners or whoever is legitimized for such purpose. It shall be understood that the authorization granted by the Data Subject to MUNILY complies with the requirements of the applicable legislation in force, when it is expressed: (i) in writing; (ii) orally; or (iii) through unequivocal conduct of the Data Subject that allows the reasonable conclusion that he/she granted MUNILY the respective authorization. In no case shall the silence of the Data Subject to issue his/her consent or authorization be assimilated by MUNILY as an unequivocal conduct. The Data Subject may at any time request MUNILY as Data Controller, the deletion of their personal data and/or revoke the authorization granted to MUNILY for the Processing of the data, for which the channels provided for in Section 3 of Chapter Twelve of this Policy have been enabled. CHAPTER VIII
HOLDER'S AUTHORIZATION FOR THE PROCESSING OF SENSITIVE DATA
In accordance with the provisions of Chapter V of this Policy, Sensitive Data is understood as: "data that affect the privacy of the Data Subject or whose improper use may generate discrimination against him/her". The processing of sensitive data referred to in Article 5° of Law 1581 of 2012 is prohibited, except for the cases listed below: - When the Data Subject has given his explicit authorization to such Processing, except in those cases where by law the granting of such authorization is not required.
- When the Processing is necessary to safeguard the vital interest of the Data Subject and he/she is physically or legally incapacitated. In these events, the legal representatives must grant their authorization.
- When the Processing is carried out in the course of legitimate activities and with due guarantees by a foundation, NGO, association or any other non-profit organization, whose purpose is political, philosophical, religious or trade union, provided that they refer exclusively to its members or persons who maintain regular contacts by reason of its purpose. In these events, the data may not be provided to third parties without the authorization of the Data Controller.
- When the Processing refers to data that are necessary for the recognition, exercise or defense of a right in a judicial process;
- When the Processing has a historical, statistical or scientific purpose. In this event, the measures leading to the suppression of the identity of the Data Controllers must be adopted.
In the Processing of sensitive personal data, when such Processing is possible in accordance with the provisions of Article 6 of Law 1581 of 2012, MUNILY complies with the following obligations: - Informs the Data Subject that since it is sensitive data, he/she is not obliged to authorize its processing.
- It informs the Data Subject explicitly and in advance, in addition to the general requirements of authorization for the collection of any type of personal data, which of the data to be processed are sensitive and the purpose of their processing, and also obtains his or her express consent.
None of the activities carried out by MUNILY is or will be conditioned on data subjects providing the Company with sensitive personal data. CHAPTER IX
USE AND PURPOSE OF THE TREATMENT
MUNILY recognizes that Data Subjects are entitled to have a reasonable expectation of privacy, taking into account their responsibilities, rights and obligations to the Company. MUNILY will use the personal data collected for the following purposes: - Execute contracts signed with customers.
- To provide security and community communication solutions in horizontal properties.
- Make payment of contractual obligations.
- Send the information to governmental or judicial entities at their express request.
- Support external and internal audit processes.
- Payroll payments, issuance of labor certifications, invitations to company events to its active workers.
- Issuance of labor certificates requested by workers who have retired from the company.
- Develop internal communication campaigns that can contain data from MUNILY employees in Colombia.
- Contact independent professionals, employees, customers and suppliers, to send commercial information that may be requested or that has to do with the contractual relationship between the parties.
- Contact professionals who send their resumes for job interviews.
- Submission of proposals that are requested either electronically, in writing or by electronic means.
- Sending e-mails containing newsletters, publications, invitations to events and information that may be relevant to customers and/or prospects.
- Sending of proposals and portfolio of services.
- Sending satisfaction surveys and service improvement programs (only for customers).
The information provided by Personal Data Holders will be used by MUNILY only for the purposes stated herein, and, therefore, we will not proceed to sell, license, transmit or disclose the same, outside the Company, unless: (i) you expressly authorize us to do so; (ii) it is necessary to do so to allow our professionals to provide our services; (iii) it is required or permitted by law or by a competent administrative or judicial authority. In order to implement the purposes described above, your personal data may be disclosed for the purposes set forth above to the personnel that make up the Human Resources Management, Administrative and Financial Management and Commercial Management. MUNILY may subcontract to third parties for the processing of certain functions or information. When we do outsource the processing of personal information to third parties or provide personal information to third party service providers, we advise such third parties of the need to protect such personal information with appropriate security measures, prohibit them from using your personal information for their own purposes, and prevent them from disclosing the personal information to others. Once the need for data processing has ceased, the data may be removed from MUNILY's databases or archived in a secure manner so that it can only be disclosed when required by law. CHAPTER X
PROCESSING OF PERSONAL DATA
This Security Policy extends and covers the various areas that are part of the processing (use, collection, circulation, storage and deletion) of personal data; the above in order to standardize procedures in the management and administration of risks in the processing of personal data. This Security Policy applies to all MUNILY's Databases containing personal data, whether digital or physical, and binds each of the areas and personnel designated for the processing of personal data. The policy shall be extended as applicable to the data processors with whom MUNILY establishes links as applicable. This document applies to all employees, contractors and personnel linked to MUNILY by virtue of any type of contractual relationship and who are involved in the processing of personal data by virtue of the development of the contract. For this purpose, personal data shall be understood as any information linked or that may be associated to natural persons. In order to be considered as personal data, you must answer affirmatively to the following question With the data I can directly or directly identify a natural person? According to Decree 1377 of 2013, MUNILY, may only collect, store, use or circulate the personal data of a person, for the time that is reasonable and necessary, according to the purposes that justified the treatment, taking into account the provisions applicable to the matter in question and the administrative, accounting, fiscal, legal and historical aspects of the information. Once the purpose or purposes of the Processing have been fulfilled and without prejudice of legal norms that provide otherwise, MUNILY shall proceed to the deletion of the personal data in its possession. As an exception to the above, MUNILY may keep the personal data when it is required to comply with a legal or contractual obligation. In cases in which MUNILY processes sensitive data, defined as any data that affects the privacy of the owner or whose improper use may generate discrimination, such data shall be protected in accordance with the framework and limitations established by law. MUNILY shall endeavor to comply with the digital and physical security measures established herein, which are adequate to ensure the security of sensitive data. Thus, all processing (use, collection, circulation, storage and filing) of personal data must be authorized by the owner according to the purposes indicated by the responsible party. Therefore, it is MUNILY's duty to ensure that the areas involved in the entire life cycle of the data comply with the provisions of the processing policy and that the personal data is effectively used according to the purposes authorized by the owner. PROCESSING OF PERSONAL DATA OF MINORS.
The processing of data of minors must be subject to the principles, parameters and requirements contained in Article 7 of Law 1581 of 2012, Article 12 of Decree 1377 of 2013 and Ruling C-778 of 2012 of the Constitutional Court.
- The processing of personal data of children under 18 years of age may be subject to processing as long as the purpose pursued is in the best interest of children and adolescents and respect for their prevailing rights is ensured without exception. In accordance with the above, the processing of personal data of children and adolescents will be exceptionally possible when the following criteria are met:
- The purpose of the treatment responds to the best interests of children and adolescents.
- To ensure respect for the fundamental rights of children and adolescents.
- According to the maturity of the child or adolescent, his or her opinion shall be taken into account.
- Compliance with the requirements set forth in Law 1581 of 2012 for the processing of personal data.
- Prior authorization is obtained from the legal representative of the minor, usually the parents.
VIDEO SURVEILLANCE
Through the Munily app it will be possible to capture the image of people and vehicles entering the condominiums that use the Munily app, who prior to entry are informed of this situation by the people in charge of the reception, who will also seek at that time the authorization of the owner. The sole purpose of these systems is the security of both the people entering the condominium and its residents.
PERSONAL DATA PROCESSOR POLICIES
The PERSON IN CHARGE is the one who carries out the processing of personal data on behalf of MUNILY, that is, the person to whom MUNILY is entrusting the management of a compendium of personal data, whether provided directly by the data owners or by third parties to MUNILY. In this sense, the personal data provided by MUNILY shall be used only for the entrusted task and in accordance with the established guidelines.
According to the Colombian regulations applicable to the protection of personal data and the jurisprudence related to the subject, the person responsible for the processing of personal data, i.e. MUNILY and THE PERSON IN CHARGE of the processing, are concurrently and jointly and severally liable to the owner of the personal data. The foregoing with respect to the veracity, integrity, purpose and incorporation of the personal data, as well as in the treatment (use, collection, storage, circulation and suppression) of the same; in the understanding that any use must be made with the authorization of the owner.
By virtue of the foregoing, THE PRINCIPAL undertakes with MUNILY to verify the delivery status of the personal data, as well as to provide the necessary security measures to ensure the security of the data according to the measures of this Security Policy. It is the duty of the PRINCIPAL to exercise the utmost diligence in the execution of its work with respect to the protection and security of personal data, both in digital and physical databases.
THE PERSON IN CHARGE is responsible for the use, custody and protection of the personal data provided by MUNILY, for which reason he/she shall be liable even for slightest fault with respect to the protection and custody of the personal data provided. Any conduct contrary to the policies set forth herein or its omission, shall engage the responsibility of the PRINCIPAL.
THE PRINCIPAL shall comply with the duties set forth in the Policy of the Person in Charge and with the other duties set forth in Article 18 of Law 1581 of 2012 and shall also be responsible for its employees or contractors.
CHAPTER XI
REVOCATION OF AUTHORIZATION AND/OR DELETION OF DATA
Data Owners may at any time request MUNILY as Data Controller, the deletion of their personal data and / or revoke the authorization granted for the processing thereof, by filing a claim, in accordance with the provisions of Article 15 of Law 1581 of 2012. However, it is important to note that the request for deletion of the information and the revocation of the authorization shall not proceed when the Data Subject has a legal or contractual duty by virtue of which it must remain in MUNILY's database. MUNILY has provided easily accessible and free mechanisms, so that the Data Owners may submit at any time requests for deletion of their data or revocation of the authorization granted. These mechanisms are set forth in paragraph 3 of Chapter XIII of this document. If upon expiration of the respective legal term, MUNILY as the Responsible Party does not remove the personal data from its databases, the Data Subject may request the Superintendence of Industry and Commerce to order the revocation of the authorization and/or the deletion of the personal data. For these purposes, the procedure described in Article 22 of Law 1581 of 2012 shall apply. Finally, it is important to highlight that personal data will be kept in MUNILY's databases when so required in compliance with a legal or contractual obligation. CHAPTER XII
RIGHTS OF DATA SUBJECTS
Pursuant to the provisions of Article 8 of Law 1581 of 2012, the rights of personal data owners are: - To know, update and rectify their personal data with respect to the Data Controllers or Data Processors. This right may be exercised, among others, against partial, inaccurate, incomplete, fractioned, misleading data, or data whose processing is expressly prohibited or has not been authorized.
- Request proof of the authorization granted to the Data Controller except when expressly exempted as a requirement for the Processing.
- To be informed by the Data Controller or the Data Processor, upon request, regarding the use that has been made of their personal data.
- File complaints before the Superintendence of Industry and Commerce for violations of the provisions of Law 1581 of 2012 and other regulations that modify, add or complement it.
- To revoke the authorization and/or request the deletion of the data when the processing does not respect the constitutional and legal principles, rights and guarantees.
- Access free of charge to personal data that have been subject to Processing.
The channels that exist in MUNILY for the exercise of the rights of the Data Subject are found in Chapter XIII of this Policy. CHAPTER XIII
PROCEDURE FOR EXERCISING YOUR RIGHTS AS A DATA SUBJECT
The rights of the Holders established in the Law may be exercised before MUNILY by the following persons: - By the Data Subject, who must provide MUNILY with sufficient proof of his or her identity.
- By the successors of the Data Subject, who must prove such quality to MUNILY.
- By the representative and/or attorney-in-fact of the Data Subject, upon accreditation before MUNILY of the representation or power of attorney.
- By stipulation in favor of or for another.
In accordance with the provisions of the applicable legislation in force, for the exercise of any of the rights of the Data Owner, any of the mechanisms set forth below may be used before MUNILY: Inquiries:
- The Data Controllers or their successors in title may consult the personal information of the Data Controller in MUNILY's databases.
- MUNILY, as the data controller, will provide to the Data Controllers or their successors in title, all the information contained in the individual record or that is linked to the identification of the Data Controller.
- The consultation shall be made through the channels enabled by MUNILY for such purpose, which are described in Section 3 of this chapter.
- The consultation will be attended by MUNILY in a maximum term of ten (10) working days counted from the date of receipt of the same.
- When it is not possible for MUNILY to attend the consultation within said term, it shall inform the interested party, stating the reasons for the delay and indicating the date on which it will attend the consultation, which in no case shall exceed five (5) business days following the expiration of the first term.
Claims:
- The Titleholders or assignees who consider that the information contained in MUNILY's databases should be corrected, updated or deleted, or when they notice the alleged breach of any of the duties contained in the law, may file a claim with MUNILY as the party responsible for the Processing, which will be processed under the following rules:
- The claim shall be formulated by means of a written request addressed to MUNILY, with the identification of the Holder, the description of the facts that give rise to the claim, the address, and accompanying the documents to be asserted.
- A photocopy of the data subject's identification document must be attached to the claim.
- The claim shall be formulated through the channels enabled by MUNILY for such purpose, which are described in Section 3 of this chapter.
- If the claim is incomplete, MUNILY will require the interested party within five (5) business days following receipt of the claim to correct the faults.
- After two (2) months from the date of the request made by MUNILY, without the applicant submitting the required information, the Company shall understand that the claim has been withdrawn.
- In the event that the person who receives the claim is not competent to resolve it, he/she will transfer it to the corresponding person within a maximum term of two (2) business days and will inform the interested party of the situation.
- Once MUNILY receives the completed claim, it will include in the database a legend indicating: claim in process and the reason for the claim, within a term no longer than two (2) business days. Such legend shall be maintained until the claim is decided.
- The maximum term for MUNILY to respond to the claim will be fifteen (15) business days from the day following the date of its receipt.
- When it is not possible for MUNILY to attend to the claim within said term, the interested party will be informed of the reasons for the delay and the date on which the claim will be attended to, which in no case may exceed eight (8) business days following the expiration of the first term.

CHAPTER XIV
MUNILY'S DUTIES AS DATA CONTROLLER
As the party responsible for the Processing of personal data, MUNILY must comply with the following duties: - Guarantee to the Data Subject, at all times, the full and effective exercise of the right of habeas data.
- Request and keep, under the conditions provided by law, a copy of the respective authorization granted by the Holder.
- Duly inform the Data Subject about the purpose of the collection and the rights he/she has by virtue of the authorization granted.
- Keep the information under the necessary security conditions to prevent its adulteration, loss, consultation, unauthorized or fraudulent use or access.
- Ensure that the information provided to the Data Processor is truthful, complete, accurate, updated, verifiable and understandable.
- Update the information, communicating in a timely manner to the Data Processor, all developments regarding the data previously provided and take other necessary measures to ensure that the information provided to it is kept up to date.
- Rectify the information when it is incorrect and communicate the pertinent to the Data Processor.
- To provide to the Data Processor, as the case may be, only data whose Processing is previously authorized in accordance with the provisions of the law.
- To require the Data Processor at all times to respect the security and privacy conditions of the Data Subject's information.
- To process queries and claims formulated in the terms set forth in the law.
- Adopt an internal manual of policies and procedures to ensure proper compliance with the law and, in particular, to deal with queries and complaints.
- Inform the Data Processor when certain information is under discussion by the Data Subject, once the claim has been filed and the respective process has not been completed.
- Inform upon request of the Data Subject about the use given to their data.
- Inform the data protection authority when there are violations to the security codes and there are risks in the administration of the information of the Data Holders.
- Comply with the instructions and requirements issued by the Superintendence of Industry and Commerce.

In this policy of treatment of personal data (the "Policy") are the corporate and legal guidelines, under which MUNILY performs the treatment of personal data, the purpose, the rights of the owners, as well as the internal and external procedures that exist for the exercise of such rights before the Company, among others: In accordance with the provisions of Article 15 of the Political Constitution of Colombia and the applicable legislation (Law 1266 of 2008, Law 1581 of 2012, Decree 1377 of 2013 and all those rules that regulate, add, repeal or modify them), in MUNILY we have a clear policy of privacy and protection of personal data that includes independent professionals, customers, suppliers, employees who have a business or legal relationship with the MUNILY Group and who have voluntarily provided their prior, express and informed consentCHAPTER III
TREATMENT POLICY BACKGROUND
The events that preceded the preparation and disclosure of this Personal Data Processing Policy are those set forth below:- Law 1581 of October 17, 2012 issued the General Regime for the Protection of Personal Data, which, according to its Article 1°, aims to: (...) develop the constitutional right that all persons have to know, update and rectify the information that has been collected about them in databases or files, and the other rights, freedoms and constitutional guarantees referred to in Article 15 of the Political Constitution; as well as the right to information enshrined in Article 20 of the same".
- Law 1581 of 2012 constitutes the general framework for the protection of personal data in Colombia.
- By Ruling C-748 of October 6, 2011, the Constitutional Court declared constitutional the Statutory Bill No. 184 of 2010 - Senate, 046 of 2010 - House of Representatives.
- By Decree 1377 of June 27, 2013, the Ministry of Commerce, Industry and Tourism regulated aspects related to the authorization of the Data Controller for the Processing of personal data, the Processing policies of the Controllers and Processors, the exercise of the rights of the Data Controllers, the transfers of personal data and the responsibility demonstrated in relation to the Processing of personal data, this last topic referring to accountability.
- By Decree 1074 of 2015, chapter 25 partially regulates Law 1581 of 2012 and chapter 26 the National Database Registry.
- Circular 002 of November 3, 2015 issued by the Superintendency of Industry and Commerce, with which the National Database Registry is enabled.
CHAPTER IV
TO WHOM THE TREATMENT POLICY IS ADDRESSED
This Personal Data Processing Policy is addressed to Clients and potential clients, Suppliers, MUNILY's Employees, both active and inactive, administrators, security guards, residents and guests of co-ownerships whose personal data is included in the Company's Databases.CHAPTER V
RELEVANT DEFINITIONS OF THE TREATMENT POLICY
For the interpretation of this Policy, the following definitions should be taken into account:- Privacy Notice: Verbal or written communication generated by the Controller, addressed to the Data Subject for the Processing of his personal data, by means of which he is informed about the existence of the information processing policies that will be applicable, the way to access them and the purposes of the Processing that is intended to be given to the personal data.
- Holder: Any person who, as final recipient, either of MUNILY's services or exercising as independent professionals, workers, Clients, and potential clients, Suppliers, MUNILY's Employees, administrators, security guards, residents and guests of co-ownerships, both active and inactive, and other persons in general.
- Personal Data: Any information linked or that can be associated to one or several determined or determinable natural persons.
- Sensitive Data: Data that affect the privacy of the Data Subject or whose improper use may generate discrimination.
- Employee: A natural person who, by virtue of an employment contract, undertakes to render a personal service to another natural or legal person, under the continued dependence or subordination of the latter and for remuneration.
- Data Processor: Natural or legal person, public or private, that by itself or in association with others, carries out the Processing of personal data on behalf of MUNILY as Data Controller.
- Processing Policy: Refers to this document, as the personal data processing policy applied by MUNILY in accordance with the guidelines of the current legislation on the matter.
- Supplier: Any natural or legal person that provides any service to MUNILY by virtue of a contractual/obligatory relationship.
- Data Controller: Natural or legal person, public or private, that by itself or in association with others, decides on the database and/or the Processing of the Data, for the purposes of this policy, MUNILY shall act as Data Controller, in principle, MUNILY.
- Transfer: Refers to the sending by MUNILY as a Data Controller or a Data Processor, to a third party agent or natural/legal person (recipient), within or outside the national territory for the effective processing of personal data.
- Transmission: Refers to the communication of personal data by the Controller to the Processor, located within or outside the national territory, so that the Processor, on behalf of the Controller, processes personal data.
- Processing: Any operation or set of operations on personal data, such as collection, storage, use, circulation or deletion.
CHAPTER VI
PRINCIPLES FOR THE PROCESSING OF PERSONAL DATA
The principles governing the Processing of Personal Data by MUNILY are the following:- Principle of Legality in data processing: The Processing referred to in Law 1581 of 2012 is a regulated activity that must be subject to what is established therein and in the other provisions that develop it.
- Principle of Purpose The processing of personal data must obey a legitimate purpose in accordance with the Constitution and the Law, which must be informed to the Data Subject.
- Principle of Freedom: The processing of personal data can only be exercised with the prior, express and informed consent of the Data Subject. Personal data may not be obtained or disclosed without prior authorization, or in the absence of legal or judicial mandate that relieves the consent.
- Principle of Truthfulness or Quality The information subject to Processing must be truthful, complete, accurate, updated, verifiable and understandable. The processing of partial, incomplete, fractioned or misleading data is prohibited.
- Principle of Transparency: The right of the Data Subject to obtain from the Data Controller or the Data Processor, at any time and without restrictions, information about the existence of data concerning him/her, must be guaranteed.
- Principle of Access and Restricted Circulation: Processing is subject to the limits derived from the nature of the personal data, the provisions of the law and the Constitution. In this sense, the Processing may only be carried out by persons authorized by the Holder and/or by the persons provided by law.
- Security Principle: The information subject to Processing by the Data Controller or Data Processor shall be handled with the technical, human and administrative measures necessary to provide security to the records avoiding their adulteration, loss, consultation, unauthorized or fraudulent use or access.
- Confidentiality Principle: All persons involved in the processing of personal data that are not of a public nature are obliged to guarantee the confidentiality of the information, even after the end of their relationship with any of the tasks involved in the processing, and may only provide or communicate personal data when it corresponds to the development of the activities authorized by law and under the terms of the same.
CHAPTER VII
HOLDER'S AUTHORIZATION FOR DATA PROCESSING
MUNILY as Data Controller has adopted procedures to request, at the latest at the time of collection of personal data, the corresponding authorization for the Processing of personal data and to inform which personal data will be collected, as well as all the specific purposes of the Processing for which consent is obtained. However, in the case of personal data that are in publicly accessible sources, regardless of the means by which they are accessed, meaning those data or databases that are available to the public, they may be processed by MUNILY, provided that, by their nature, they are public data. MUNILY as Responsible for the Processing of personal data has established mechanisms to obtain the authorization of the Owners or whoever is legitimized for such purpose. It shall be understood that the authorization granted by the Data Subject to MUNILY complies with the requirements of the applicable legislation in force, when it is expressed: (i) in writing; (ii) orally; or (iii) through unequivocal conduct of the Data Subject that allows the reasonable conclusion that he/she granted MUNILY the respective authorization. In no case shall the silence of the Data Subject to issue his/her consent or authorization be assimilated by MUNILY as an unequivocal conduct. The Data Subject may at any time request MUNILY as Data Controller, the deletion of their personal data and/or revoke the authorization granted to MUNILY for the Processing of the data, for which the channels provided for in Section 3 of Chapter Twelve of this Policy have been enabled.CHAPTER VIII
HOLDER'S AUTHORIZATION FOR THE PROCESSING OF SENSITIVE DATA
In accordance with the provisions of Chapter V of this Policy, Sensitive Data is understood as: "data that affect the privacy of the Data Subject or whose improper use may generate discrimination against him/her". The processing of sensitive data referred to in Article 5° of Law 1581 of 2012 is prohibited, except for the cases listed below:- When the Data Subject has given his explicit authorization to such Processing, except in those cases where by law the granting of such authorization is not required.
- When the Processing is necessary to safeguard the vital interest of the Data Subject and he/she is physically or legally incapacitated. In these events, the legal representatives must grant their authorization.
- When the Processing is carried out in the course of legitimate activities and with due guarantees by a foundation, NGO, association or any other non-profit organization, whose purpose is political, philosophical, religious or trade union, provided that they refer exclusively to its members or persons who maintain regular contacts by reason of its purpose. In these events, the data may not be provided to third parties without the authorization of the Data Controller.
- When the Processing refers to data that are necessary for the recognition, exercise or defense of a right in a judicial process;
- When the Processing has a historical, statistical or scientific purpose. In this event, the measures leading to the suppression of the identity of the Data Controllers must be adopted.
- Informs the Data Subject that since it is sensitive data, he/she is not obliged to authorize its processing.
- It informs the Data Subject explicitly and in advance, in addition to the general requirements of authorization for the collection of any type of personal data, which of the data to be processed are sensitive and the purpose of their processing, and also obtains his or her express consent.
CHAPTER IX
USE AND PURPOSE OF THE TREATMENT
MUNILY recognizes that Data Subjects are entitled to have a reasonable expectation of privacy, taking into account their responsibilities, rights and obligations to the Company. MUNILY will use the personal data collected for the following purposes:- Execute contracts signed with customers.
- To provide security and community communication solutions in horizontal properties.
- Make payment of contractual obligations.
- Send the information to governmental or judicial entities at their express request.
- Support external and internal audit processes.
- Payroll payments, issuance of labor certifications, invitations to company events to its active workers.
- Issuance of labor certificates requested by workers who have retired from the company.
- Develop internal communication campaigns that can contain data from MUNILY employees in Colombia.
- Contact independent professionals, employees, customers and suppliers, to send commercial information that may be requested or that has to do with the contractual relationship between the parties.
- Contact professionals who send their resumes for job interviews.
- Submission of proposals that are requested either electronically, in writing or by electronic means.
- Sending e-mails containing newsletters, publications, invitations to events and information that may be relevant to customers and/or prospects.
- Sending of proposals and portfolio of services.
- Sending satisfaction surveys and service improvement programs (only for customers).
CHAPTER X
PROCESSING OF PERSONAL DATA
This Security Policy extends and covers the various areas that are part of the processing (use, collection, circulation, storage and deletion) of personal data; the above in order to standardize procedures in the management and administration of risks in the processing of personal data. This Security Policy applies to all MUNILY's Databases containing personal data, whether digital or physical, and binds each of the areas and personnel designated for the processing of personal data. The policy shall be extended as applicable to the data processors with whom MUNILY establishes links as applicable. This document applies to all employees, contractors and personnel linked to MUNILY by virtue of any type of contractual relationship and who are involved in the processing of personal data by virtue of the development of the contract. For this purpose, personal data shall be understood as any information linked or that may be associated to natural persons. In order to be considered as personal data, you must answer affirmatively to the following question With the data I can directly or directly identify a natural person? According to Decree 1377 of 2013, MUNILY, may only collect, store, use or circulate the personal data of a person, for the time that is reasonable and necessary, according to the purposes that justified the treatment, taking into account the provisions applicable to the matter in question and the administrative, accounting, fiscal, legal and historical aspects of the information. Once the purpose or purposes of the Processing have been fulfilled and without prejudice of legal norms that provide otherwise, MUNILY shall proceed to the deletion of the personal data in its possession. As an exception to the above, MUNILY may keep the personal data when it is required to comply with a legal or contractual obligation. In cases in which MUNILY processes sensitive data, defined as any data that affects the privacy of the owner or whose improper use may generate discrimination, such data shall be protected in accordance with the framework and limitations established by law. MUNILY shall endeavor to comply with the digital and physical security measures established herein, which are adequate to ensure the security of sensitive data. Thus, all processing (use, collection, circulation, storage and filing) of personal data must be authorized by the owner according to the purposes indicated by the responsible party. Therefore, it is MUNILY's duty to ensure that the areas involved in the entire life cycle of the data comply with the provisions of the processing policy and that the personal data is effectively used according to the purposes authorized by the owner.PROCESSING OF PERSONAL DATA OF MINORS.
The processing of data of minors must be subject to the principles, parameters and requirements contained in Article 7 of Law 1581 of 2012, Article 12 of Decree 1377 of 2013 and Ruling C-778 of 2012 of the Constitutional Court.
- The processing of personal data of children under 18 years of age may be subject to processing as long as the purpose pursued is in the best interest of children and adolescents and respect for their prevailing rights is ensured without exception. In accordance with the above, the processing of personal data of children and adolescents will be exceptionally possible when the following criteria are met:
- The purpose of the treatment responds to the best interests of children and adolescents.
- To ensure respect for the fundamental rights of children and adolescents.
- According to the maturity of the child or adolescent, his or her opinion shall be taken into account.
- Compliance with the requirements set forth in Law 1581 of 2012 for the processing of personal data.
- Prior authorization is obtained from the legal representative of the minor, usually the parents.
VIDEO SURVEILLANCE
Through the Munily app it will be possible to capture the image of people and vehicles entering the condominiums that use the Munily app, who prior to entry are informed of this situation by the people in charge of the reception, who will also seek at that time the authorization of the owner. The sole purpose of these systems is the security of both the people entering the condominium and its residents.
PERSONAL DATA PROCESSOR POLICIES
The PERSON IN CHARGE is the one who carries out the processing of personal data on behalf of MUNILY, that is, the person to whom MUNILY is entrusting the management of a compendium of personal data, whether provided directly by the data owners or by third parties to MUNILY. In this sense, the personal data provided by MUNILY shall be used only for the entrusted task and in accordance with the established guidelines.
According to the Colombian regulations applicable to the protection of personal data and the jurisprudence related to the subject, the person responsible for the processing of personal data, i.e. MUNILY and THE PERSON IN CHARGE of the processing, are concurrently and jointly and severally liable to the owner of the personal data. The foregoing with respect to the veracity, integrity, purpose and incorporation of the personal data, as well as in the treatment (use, collection, storage, circulation and suppression) of the same; in the understanding that any use must be made with the authorization of the owner.
By virtue of the foregoing, THE PRINCIPAL undertakes with MUNILY to verify the delivery status of the personal data, as well as to provide the necessary security measures to ensure the security of the data according to the measures of this Security Policy. It is the duty of the PRINCIPAL to exercise the utmost diligence in the execution of its work with respect to the protection and security of personal data, both in digital and physical databases.
THE PERSON IN CHARGE is responsible for the use, custody and protection of the personal data provided by MUNILY, for which reason he/she shall be liable even for slightest fault with respect to the protection and custody of the personal data provided. Any conduct contrary to the policies set forth herein or its omission, shall engage the responsibility of the PRINCIPAL.
THE PRINCIPAL shall comply with the duties set forth in the Policy of the Person in Charge and with the other duties set forth in Article 18 of Law 1581 of 2012 and shall also be responsible for its employees or contractors.
CHAPTER XI
REVOCATION OF AUTHORIZATION AND/OR DELETION OF DATA
Data Owners may at any time request MUNILY as Data Controller, the deletion of their personal data and / or revoke the authorization granted for the processing thereof, by filing a claim, in accordance with the provisions of Article 15 of Law 1581 of 2012. However, it is important to note that the request for deletion of the information and the revocation of the authorization shall not proceed when the Data Subject has a legal or contractual duty by virtue of which it must remain in MUNILY's database. MUNILY has provided easily accessible and free mechanisms, so that the Data Owners may submit at any time requests for deletion of their data or revocation of the authorization granted. These mechanisms are set forth in paragraph 3 of Chapter XIII of this document. If upon expiration of the respective legal term, MUNILY as the Responsible Party does not remove the personal data from its databases, the Data Subject may request the Superintendence of Industry and Commerce to order the revocation of the authorization and/or the deletion of the personal data. For these purposes, the procedure described in Article 22 of Law 1581 of 2012 shall apply. Finally, it is important to highlight that personal data will be kept in MUNILY's databases when so required in compliance with a legal or contractual obligation.CHAPTER XII
RIGHTS OF DATA SUBJECTS
Pursuant to the provisions of Article 8 of Law 1581 of 2012, the rights of personal data owners are:- To know, update and rectify their personal data with respect to the Data Controllers or Data Processors. This right may be exercised, among others, against partial, inaccurate, incomplete, fractioned, misleading data, or data whose processing is expressly prohibited or has not been authorized.
- Request proof of the authorization granted to the Data Controller except when expressly exempted as a requirement for the Processing.
- To be informed by the Data Controller or the Data Processor, upon request, regarding the use that has been made of their personal data.
- File complaints before the Superintendence of Industry and Commerce for violations of the provisions of Law 1581 of 2012 and other regulations that modify, add or complement it.
- To revoke the authorization and/or request the deletion of the data when the processing does not respect the constitutional and legal principles, rights and guarantees.
- Access free of charge to personal data that have been subject to Processing.
CHAPTER XIII
PROCEDURE FOR EXERCISING YOUR RIGHTS AS A DATA SUBJECT
The rights of the Holders established in the Law may be exercised before MUNILY by the following persons:- By the Data Subject, who must provide MUNILY with sufficient proof of his or her identity.
- By the successors of the Data Subject, who must prove such quality to MUNILY.
- By the representative and/or attorney-in-fact of the Data Subject, upon accreditation before MUNILY of the representation or power of attorney.
- By stipulation in favor of or for another.
Inquiries:
- The Data Controllers or their successors in title may consult the personal information of the Data Controller in MUNILY's databases.
- MUNILY, as the data controller, will provide to the Data Controllers or their successors in title, all the information contained in the individual record or that is linked to the identification of the Data Controller.
- The consultation shall be made through the channels enabled by MUNILY for such purpose, which are described in Section 3 of this chapter.
- The consultation will be attended by MUNILY in a maximum term of ten (10) working days counted from the date of receipt of the same.
- When it is not possible for MUNILY to attend the consultation within said term, it shall inform the interested party, stating the reasons for the delay and indicating the date on which it will attend the consultation, which in no case shall exceed five (5) business days following the expiration of the first term.
Claims:
- The Titleholders or assignees who consider that the information contained in MUNILY's databases should be corrected, updated or deleted, or when they notice the alleged breach of any of the duties contained in the law, may file a claim with MUNILY as the party responsible for the Processing, which will be processed under the following rules:
- The claim shall be formulated by means of a written request addressed to MUNILY, with the identification of the Holder, the description of the facts that give rise to the claim, the address, and accompanying the documents to be asserted.
- A photocopy of the data subject's identification document must be attached to the claim.
- The claim shall be formulated through the channels enabled by MUNILY for such purpose, which are described in Section 3 of this chapter.
- If the claim is incomplete, MUNILY will require the interested party within five (5) business days following receipt of the claim to correct the faults.
- After two (2) months from the date of the request made by MUNILY, without the applicant submitting the required information, the Company shall understand that the claim has been withdrawn.
- In the event that the person who receives the claim is not competent to resolve it, he/she will transfer it to the corresponding person within a maximum term of two (2) business days and will inform the interested party of the situation.
- Once MUNILY receives the completed claim, it will include in the database a legend indicating: claim in process and the reason for the claim, within a term no longer than two (2) business days. Such legend shall be maintained until the claim is decided.
- The maximum term for MUNILY to respond to the claim will be fifteen (15) business days from the day following the date of its receipt.
- When it is not possible for MUNILY to attend to the claim within said term, the interested party will be informed of the reasons for the delay and the date on which the claim will be attended to, which in no case may exceed eight (8) business days following the expiration of the first term.

CHAPTER XIV
MUNILY'S DUTIES AS DATA CONTROLLER
As the party responsible for the Processing of personal data, MUNILY must comply with the following duties:- Guarantee to the Data Subject, at all times, the full and effective exercise of the right of habeas data.
- Request and keep, under the conditions provided by law, a copy of the respective authorization granted by the Holder.
- Duly inform the Data Subject about the purpose of the collection and the rights he/she has by virtue of the authorization granted.
- Keep the information under the necessary security conditions to prevent its adulteration, loss, consultation, unauthorized or fraudulent use or access.
- Ensure that the information provided to the Data Processor is truthful, complete, accurate, updated, verifiable and understandable.
- Update the information, communicating in a timely manner to the Data Processor, all developments regarding the data previously provided and take other necessary measures to ensure that the information provided to it is kept up to date.
- Rectify the information when it is incorrect and communicate the pertinent to the Data Processor.
- To provide to the Data Processor, as the case may be, only data whose Processing is previously authorized in accordance with the provisions of the law.
- To require the Data Processor at all times to respect the security and privacy conditions of the Data Subject's information.
- To process queries and claims formulated in the terms set forth in the law.
- Adopt an internal manual of policies and procedures to ensure proper compliance with the law and, in particular, to deal with queries and complaints.
- Inform the Data Processor when certain information is under discussion by the Data Subject, once the claim has been filed and the respective process has not been completed.
- Inform upon request of the Data Subject about the use given to their data.
- Inform the data protection authority when there are violations to the security codes and there are risks in the administration of the information of the Data Holders.
- Comply with the instructions and requirements issued by the Superintendence of Industry and Commerce.
CHAPTER XV
